Rabbi held for allegedly hiding monstrous sex crime record
An ultra-Orthodox rabbi from Israel is being held in New York without bail for allegedly hiding his monstrous sex crime record in order to get a US visa and come to New York.
Yakov Yitzchak Roth — a “rebbe” in the Hasidic group Shomrei Emunim — was arrested Tuesday in Borough Park by cops with the NYPD Special Victim’s Squad.
He had flown here from Tel Aviv in late August after swearing in a visa application that he had never been arrested or convicted, according to the federal complaint against him.
In reality, just six months earlier he had finished serving a 16-year sentence on his 1997 conviction in the District Court of Tel Aviv for raping, sodomizing and sexually assaulting a child relative, the complaint said.
Roth’s attorney, Shulamis Peltz, declined to comment on the case, except to say, “The current allegations are just allegations and have not been proven.”
Roth, whose father, Rabbi Avraham Chaim Roth, led a small congregation of 200 followers in Jerusalem before his death in August, 2012, is due back in Brooklyn Federal Court for a bail hearing on Monday.

This is the son of the late Shomer Emunim Rebbe, who was in prison. It’s an alter maaseh, and well known. Either you believe his conviction was correct, your you don’t. The old Rebbe clearly didn’t believe it. He left in his tzavo’oh that this son should also be a rebbe just like his brothers, and that the other sons shouldn’t take up their positions until he got out of prison so he could take his position at the same time.
This current story seems to be about not filling in a form correctly; I doubt he filled it in himself. Presumably the travel agent did it, and may not have thought to ask him the question.

So many euphamisms and excuses.
‘He was in prison’ instead of instead of = He was convicted and jailed of sodomizing children.
‘It’s an alter maaesh’ which means = It’s so old you shouldn’t even think about it and it becomes untrue after a long time.
‘Either you believe his conviction was correct, your you don’t.’ which means = He was unfairly convicted and unfairly jailed.
‘The old Rebbe clearly didn’t believe it.’ which means = Which proves it never happened.
‘This current story seems to be about not filling in a form correctly’ and really = It was a simple mistake anyone could have done; these things happen daily, especially on stat decs and formal, written contracts. They don’t mean anything anyway. You can go to Bais Din and have it reversed. He thought they only wanted his signature because he is a Rebbe.
‘I doubt he filled it in himself.’ = He does the same with all stat decs and contracts.
‘Presumably the travel agent did it, and may not have thought to ask him the question.’ = He didn’t even do it, he wasn’t there when it happened, it was the travel agent’s and Shultz’s fault.

Why would you think he fills in his own visa application? That’s what travel agents are for. Especially when a) you don’t read English, and b) you’re a rebbe with far better things to do than filling in paperwork.
And why do you give more credibility to an Israeli judge than to a talmid chochom?
Isaac, a form is not a shtar, and dina demalchusa (especially of a malchus to which he has no connection) has nothing to do with it. Dina means a determination of who owns a piece of property, nothing else.

Because there is no mitzvah to fill in forms. Nowhere is it listed as one of the forms of serving Hashem. Paperwork is a bureaucratic requirement, something that has to be got through, and if you can get someone else to do it for you, you do. Especially when it’s in a foreign language. Your claim was that the great mitzvah of “dina demalchusa”, which is surely one of the asseres hadibros, or at least one of the 613 mitzvos, means that every government form (of every country, whether you live there or not) is a sefer torah, and a talmid chochom must inspect it with reverence to ensure its complete accuracy, perhaps going to mikveh first and wearing a gartel because it has the holy logo of the holy government on it. If it’s in Chinese, learn Chinese so you can fill it in yourself. Chas vesholom to delegate it to a travel agent, and sign where he tells you.
In other words, why would you even imagine that he filled the visa application himself. Even an English-speaking busy CEO doesn’t do that, let alone a foreign rebbe.

Are you seriously claiming that those whose job it is to know exactly what their Master is doing and fulfill his obligations as agents, somehow divorce the person from all the claims made on a form? Who signed? Why sign if you don’t read or understand? Is that your claim?

The question is not if his is guilty or innocent, but whether he had a criminal record.
A Rebbe is not always a TALMID CHOCHOM. If he got into this mess, he surely is not a Talmid Chochom.
You say “you’re a rebbe with far better things to do than filling in paperwork.” For instance what? A learned man knows that by signing a declaration he approves what is written in it and takes all the responsibility for it.
Dina dmalchusa – no connection? If he wants to enter a country, than he has to comply with the malchusa of that country.

A Talmid Chacham isn’t infallible.
That’s one of the main problems today in the Litvishe and Chassidishe world. We have a din of Kvod Talmidei Chachomim and we must be scrupulous (I particularly like this Siman as expounded by the Aruch Hashulchan) but we are ALL humans.

There is a saying of a Rabbi (not Rebbe): Rabbi Meir is a Talmid Chochom d’Oraisa but an Am Ho’oretz deRabonon.

For instance what? For instance learning another line of gemara or another se’if in shulchan aruch. Formalities are a chore, to be done only if there is nobody else to do them.

In all his learnings, where did he find justification for “raping, sodomizing and sexually assaulting a child relative”? Was it in his learning of “another se’if in shulhan aruch”?
He had plenty of time to study in jail – 16 years. I assume that he did study there – probably MESECHET SANHEDRIN.

You do not enter a foreign country without permission. If you apply for permission you have to comply with the stipulations of the permit. Even Moses asked permission from SICHON the King of CHESBON to pass through his kingdom and stipulated לא אסור ימין ושמאל.
Do you think that if “you” did not find anyone “Who says that if one intends to enter a country one must obey the malchus of that country?” you can take the law into your own hands and disobey any ruling of that country? Did you ask a Rabbi? Did he tell you that you do not have to obey that country’s laws? He will find for you the relevant supports. You are a guest גר ותושב in that country, and guests do what the BA’AL HABAYIT says.

In other words it’s not a scandal, let alone a chilul hashem, that a form was filled inaccurately. It’s a mistake that shouldn’t have happened, but it did; now he’s in trouble because of it, but why should this concern us at all?
