An unusual advertisement appeared on a number of ultra-Orthodox websites at the end of last week. “A group of Yeshiva students is organizing to volunteer with the reserves. Want to join?” it read.

“We believe that the people of Israel are in the midst of an obligatory war against ruthless enemies who seek to annihilate us,” the ad continued, using biblical language for a battle that all Jews are obligated to fight.

“We believe it is a great privilege to join the military effort, in addition to our important contribution through Torah study. We too yearn for this precious mitzvah.”

The message was an outlier in a community where army service is still taboo. Israel’s ultra-Orthodox, or Haredi community, which comprises 10 percent of the country’s total population, has traditionally shied away from service. From the founding of Israel until this year, Haredi men could postpone their mandatory military conscription indefinitely, as long as they were registered for study in a high religious institution, or kolel. This de-facto exemption ended when a new universal conscription law drafted by Benjamin Netanyahu’s coalition passed in the Knesset on March 12. A three-year transitional period, ending in 2017, allows men exempted from service in the past to continue avoiding the draft.

The advertisement, published on two leading Haredi news sites, sends applicants to an online form inquiring about age, marital status and employment status.

“There is no risk of the army drafting you for service if you’re exempt, or that you will get stuck in the army against your will,” the advertisement reassures worried inquirers.

Yossef, a 40-year-old father of six from Jerusalem who serves as the initiative’s publicity coordinator, told The Times of Israel that the online campaign has garnered 500 volunteers since the ad went online Friday, with new people stepping forward every day.

He estimated that a total of 1,500-2,000 will end up signing on for two possible tracks: a combat track for younger, unmarried men to be trained with new immigrants and to join existing fighting units; and a shorter track for older volunteers, comprising multiple-day basic training followed by a commitment to volunteer in the reserves 12 days a year for five years.

He said senior officers within the military have expressed excitement about the idea. A request to the IDF Spokesperson’s Unit for comment was not answered.

“The volunteer position must be significant, otherwise it’s pointless,” Yossef told The Times of Israel. “It’s not just something symbolic for us to check off and say, ‘Look, we came to serve in the army.’ People really want to contribute, and not simply as watchdogs in some remote installation. The volunteers also need satisfaction in their work.”

The initiative was the brainchild of five adult students based in Jerusalem, who have long debated the idea of volunteering for the army. The kidnapping and killing of three Israeli teenagers in June, and IDF Operation Brother’s Keeper, which ensued in the West Bank, spurred them into action.

[Military service] doesn’t contradict our contribution through Torah study.”

But volunteering for the army is, Yossef acknowledged, also a show of defiance against a government that has decided to shove service down their throats. If Haredim were given a mass exemption from the army, many would volunteer to serve in the IDF and join the workforce, and “70 percent of yeshivot (religious institutions) would empty,” he said.

“We wanted to show both the army and our own public that there is a different way of doing things,” Yossef added, withholding his real name and the names of the other initiators, for fear of an angry backlash from hardliners within his community. “The forced draft is a big mistake on the part of the state, but no one — neither the rabbis, nor anyone else — can say anything against volunteering for the IDF reserves. It’s just like volunteering with the police, Magen David Adom (the Israeli ambulance service) or Zaka (the Haredi disaster victim identification organization). It doesn’t harm the Haredi lifestyle.”

The IDF has been trying to convince the ultra-Orthodox for years that military service and the Haredi way of life are not mutually exclusive. In 2002 it created the Netzah Yehuda Battalion, formerly known as Nahal Haredi, where ultra-observant men can volunteer to serve as combat soldiers in a unisex environment, eating strictly supervised kosher food and dedicating time for prayer and Torah study. But critics of the program say it caters to those on the fringes of Haredi society, not those at its heart.

Yossef believes that the volunteer track into the IDF will prove much more successful in the long run than the draft approved by the Knesset earlier this year. For that reason, he opined, some elements in the Haredi community fear this experiment. Dozens of hate messages have arrived with the online application forms over the past week.

“If we expose any names, those people’s children will be thrown out of their Haredi schools because the extremists will go threaten the schoolmasters,” he said.

“It’s not a simple thing we’re doing,” concluded Yossef, one of relatively few Haredim who served in the IDF and reserves. “But it’s very inspiring. Even though I’ve been discharged, I think I’ll join the first training course. This is something special.”

A soldier on the border writes:

What’s happening here in the staging area [area where soldiers prepare to enter Gaza] is beyond comprehension, not rationally, not emotionally and begs the imagination.

Almost every hour a car shows up overflowing with food, snacks, cold drinks, socks, underwear, undershirts, hygiene supplies, wipes, cigarettes, v backgammon and more. They’re coming from the North and the Center, from manufacturers, from companies and private businesses, from prisons, Chareidim and Settlers, from Tel Aviv and even Saviyon.

Every intersection on they way down here we get stopped, not by the police, but be residents giving out food. What is amazing is that the entire situation b organized and everyone is coming on their own without coordination between the folks coming.

They’re writing letters and blessings, how they’re thinking of us all the time. There are those who spent hours making sandwiches, so they’re as perfect and comforting as possible.

Of course representatives of Chabad are here to help soldiers put on Tefillin and distributing Cha’Ta’Ts (Chumash, Tehillim, Tanya) for every troop transport and Breslov are showing up to the border and dancing with the soldiers with great joy.

The Chareidim are coming from their yeshivot to ask the names of the soldiers with their mothers’ names so that the whole yeshiva can pray for them. It should be mentioned that all of this is done under the threat of the terrorist tunnels and rockets in the area.
Soroka Hospital (in Be’er Sheva) today looks like a 5 star hotel. A wounded friend who was recently discharged told us how the MasterChef truck is parked outside and is preparing food for the wounded.

It goes without saying the amount of prayer services that are going on. On the religious front as well, there are lectures and Torah classes, all the food is obviously Kosher. Shachrit, Mincha, and Maariv with Sifrei Torah. They’re giving out tzitzit and Tehilim by the hundreds. It’s become the new fashion! The Rabbi of Maglan [Special Forces unit] told me that almost the entire unit has started wearing them, because the Army Rabbinate has been giving out tzitzit that wick away sweat. They’re gaining both a Mitzva and a high quality undershirt. We’ve started calling them “Shachpatzitzti” (a portmanteau of the Hebrew term for body armor and tzitzit). We’re having deep conversations late into the night without arguments, without fights and we find ourselves agreeing on most stuff.

We’re making lots of jokes at Hamas’s expensive and without politics. There’s lots more to add but my battery is running low and the staff has been requesting someonekm give a class on Likutei MoharaN (Breslov).

How happy is the nation that is like this.

Maybe it’s not just Beck and Neturei Karta?

I’m sure many of us are spending time defending Israel and its rightful inhabitants at work, in forums, in comments on various newspapers (I had a totally benign comment of mine censored by the Economist, no less)

These are TOUGH times. Jewish soccer players get attacked on the pitch. We read that a shop in Belgium hung a large sign saying ‘no entry to Zionists or dogs’ and then had Zionists replaced by the word Jews. Our people fight those who want to annihilate us every minute and protect Jewish lives. Is it Torah that doesn’t see a missile on Bnei Brak or is it the Enemy themselves who perceive such enclaves as their friends?

Many in Europe of all places are facing violence and huge barrages of protest which invariably link us to hitler Yimach Shemo Vezichro. There is a very clear approach being taken by haters of Jews.

This morning someone sent me a phone picture of a demonstration in Paris taken by a bystander. I don’t have words to describe how sick in the guts I felt seeing these low lives joining those who would be happy to see us wiped out.

I am thinking that we need a web page, a World-Wide page, of faces and names. Anyone from any country in the world who joins these protests, is made visible in their anti israel views and should be named alongside their picture.

Here is the picture that raised my blood pressure significantly.

Polemic with Hamas/Palestinian supporters and Mr Moshe Ber Beck

I have argued Israel’s case strenuously in a number of internet forums during the current operation  to defend Israel from Hamas. It was incredible, that my Muslim interlocutors kept publishing videos of Mr Moshe Ber Beck showing me that even Jews are against Israel.

Oh yes, I can tell them that the disgraceful Beck is generally described as a fringe lunatic, but do you think they believe me? They point out that all the ones with long side locks and funny hats and beards are just like Moshe Ber Beck, and there are plenty of them.

I’m embarrassed that someone like Beck (whose voice sounds eerily but unsurprisingly similar to his Melbourne brother) can’t keep his mouth shut and hide in a deep hole somewhere in the Antarctica or Siberia. Perhaps he and his like-minded ilk should find the same hole that the two assassins used to murder the three boys הי’’ד are hiding in: Beck and Co are just one moral rung down from them.

I’d expect to see posters all over Israel, especially Meah Shearim condemning Beck, but the Mashiach will be here before that happens.

Barking up the wrong tree

Instead of disarming Hamas, all we read about is the number of rockets, number of intercepts by the Iron Dome, and stress and number of near misses and trauma.

WAKE UP ISRAEL. THE WORLD DOESNT CARE ABOUT THE NUMBERS. THEY BLAME YOU. FORGET THEM.

Just go in and disarm HAMAS and destroy their infrastructure. That’s the ONLY response, and the ONLY language they understand. If that sparks Hezbollah then flatten Lebanon.

A sense of shame and חילול השם

It’s somewhat ironic that during the week of Parshas Pinchas, where the grandson of Aron HaKohen, failed to consult with the Manhig HaDor, Moshe Rabeinu, and murdered the two lust-filled people who were cavorting in a tent. I hear you say that Hashem gave Pinchas the Bris of שלום albeit with a shortened Vav and there are many explanations in this regard. I will leave it to readers to refresh their memories and check the myriad of diametrically opposed explanations of this act.

Fast forward. Three תנוקות של בית רבן, Yeshiva Students of the highest calibre were short and murdered because they were Jewish. Had they been Muslims, they would not have been shot or kidnapped. The perpetrators seem to be hiding in caves somewhere in the Chevron region. Time will tell. They will be caught and they will receive, hopefully, a life sentence behind bars, with no remission, and no luxuries.

It is now pretty clear that some,  overcome with the grief of this incident coupled with their sense of vengeance felt that they could take the law into their own hands and incinerate a Muslim boy in return. This is anathema. It is anathema not just in Jewish Law, but even B’nei Noach are meant to have proper courts of laws and systems. Society cannot exist while people are taking the law into their own hands. Did they even listen to the words of the parents of the slain קדושים’s parents? Did they think that the man hunt wasn’t on an enormous scale with the aim of catching the low lives who perpetrated this disgraceful act.

Yes, we can show that we didn’t demonstrate, burn tyres, cause all range of mass violence in reaction, but some, albeit a few, had been brought up and inculcated, no different to the murderer of Yitzchak Rabin, to take the law into their own hands.

This was an opportunity to demonstrate a Kiddush Hashem. The parents were inspiring. The world was watching, and then some wild ones קנאים decided that they owned the right to respond for the parents and for the State. They too must be brought to justice, and they too must be jailed for the rest of their lives, in an Israeli Jail, without the comforts of a good living. No “Glatt Kosher/Daf HaYomi” Jail for them. They should do physical labour and go to sleep each night exhausted. For they have defamed the name of Hashem Yisborach, and that in turn defames the name and kedusha of Am Yisrael.

From afar, I do not believe in territorial concessions. I believe one must be aggressive in expansion and only this will bring the Jordanian Palestinians to their senses. Either they want one state in Yehuda and Shomron, or they do not. Until they renounce violence and completely disarm, they cannot be partners for peace. Until that time, Jews have the same right to live in the previously declared Jordanian territory as anyone else. If they don’t like it, then they should negotiate. No Israeli Prime Minister from the left of the left to the right of the right has managed to find a partner for peace. Abbas is just a pretty western suit with a coiffured moustache. It’s only a matter of time before he dies of old age or sickness and then there is nobody else. He hasn’t got the guts to do anything because, unlike Sadat, he is afraid. He is afraid that someone will blow his head off. Let him go to his grave afraid. In the meantime, there is nobody with authority or credibility to talk to.

Then there is the enemy in our midst. If a Palestinian State was to be established, then Jews should be permitted to live there. If they are not, then all Palestinians within Israel should be asked to politely leave before they are forcibly removed. We live under the façade of a holy democracy. It is an incredible democracy but it has allowed people who are not genuine citizens to pretend that they are part of Israel. Anyone not ready to sing Hatikva, fight in the IDF, and do their civic duty is not a Citizen of the State. I don’t care who they are. It’s a free world. They can go to Jordan or Yehuda VeShomron or Williamsburg and live a free life over there if they hate Israel. Let’s face it, most loathe Israel.

Ironically, the words of Aharon of Satmer are but a pimple compared the acts of these Jewish young adults.

Extremists on both sides need to be sidelined. The Meretz Morons whose philosophies are astronomically in the realm of cosmology cause as much trouble as the right wing automatons who have grown out of the ill-fated Gush Emunim movement. Rav Amital would be turning in his grave.

The Chief Rabbis should have (maybe they did) attended the funeral of the Muslim Boy, and sought out his Imam, to apologise for the extremists who decided that price tag was some sort of Hetter to commit חילול שם שמים. We don’t say ה׳ ינקום דמם for no reason. Yes, we must bring them to justice, but Hashem will ultimately deal with their future, and if he sees his people behaving with similar savagery, will he be happy? I don’t know.

What I do know, is that we cannot be Hashem’s accountants. There are all sorts of Rebbalach and more who think they know why Hashem oversees certain things. They would do better by simply following והלכת בדרכיו

We don’t need more accountancy from self-appointed accountants of Hashem’s Cheshbonos. We can only deal with the here and now. The here and now is ugly and we must not let these חיות רעות invade the HOLINESS of our religion. Theirs is a profanation that cannot be countenanced.

They aren’t Pinchas. They have no Moshe. They certainly didn’t make בריתי שלום

I am heart broken to read of the murder of the three boys. Apart from Nikmas Dam Avodecho, We need to add 10 minutes of Mishnayos learning per day for each of them.

Give us back our boys (Part 2)

After the Caulfield Shule event there was much murmuring from sections of the community about aspects that they didn’t like. This is not to imply they had a problem with the event. The feeling was positive.

I’d like to consider each one (that I know of) and that have been broadly canvassed, and offer my view, for what it’s worth. These are in no particular order.

  1. Umbrage was expressed that the Rabbinic President of the RCV and ORA was using his phone from the daïs to take panoramic pictures/videos from his place while people were involved in the event.
    My view is that this was ill-advised, and not in keeping with the solemnity and angst of the event. There were adequate photographers and the ubiquitous Channel 31 fellow quite able to take pictures and video as need be.
  2. Offence was expressed that some Rabbinic figures failed to sing HaTikva
    My view on HaTikva was formed many decades ago when I discussed the matter with a Rav from Mercaz HaRav, as a young Yeshivah Bochur during the summer break at Moshav Keshet. That is a story in of itself. The Rav was fiercely Religious Zionist, and our site was literally on the border with Syria. When we threw a rock over the barbed wire fence near where we worked each day, it was common for a mine or some other incendiary device to detonate. The Rav was obviously very spiritual. I remember waiting twenty minutes for him to finish davening Mincha after we had all finished to engage him in discussing the matter. His view was that it was unfortunate that God’s name is not mentioned therein and that there was no seeming connection to Torah. Nonetheless, he felt that when in a place where people were singing it as an anthem, not doing so, would likely cause some to make the wrong reading, and that this itself could estrange Jews from Judaism, so to speak. He told me that he made one substitution when he sang it in such situations. Instead of Lihyot Am Chofshi, he used Lihyot Am Torah B’Artzenu and suggested I focus on Hashem’s hand and Ein Lecha Ben Chorin Ela Mi Sheosek BaTorah. Since that time, I have tried to do so. Chofshi, can mean many things, but to secularists this can range from freedom to possibly freedom of the yoke of religion/heaven (from the vantage of a more Charedi reading). As my own children grew up, they noticed me making this substitution. Whether they do, is a matter for themselves. 
    That being said, it is unwise to be standing there in public view without one’s lips moving even if someone is theologically opposed. I understand that some might turn their back so nobody would notice. I understand that some have other objections. I could even foresee the bleeding left-wing objecting to the anthem on the grounds that it is difficult for an Arab Israeli to sing (this has been in the news in fact). Either way, one should absent oneself in an inconspicuous manner so as not to create heat. I saw one Rabbi leave as soon as Tehillim was over. That’s his right. It’s for his congregation to interpret. Nobody forces a Rabbi to sit anywhere they don’t want to.

    In of itself, there is nothing holy about an anthem, of course. This does not imply that one is opposed in some way to the notion that the birth of the State was Yad Hashem and a miraculous event. Let’s face facts. The majority of the RCV are not Religious Zionists, including the President nor do they need to be in terms of any constitution or mandate that I am aware of.

  3. Some from the more Charedi spectrum, who made an effort to attend in name of unity, felt that the Tefilla Lishlom HaMedina was contentious.
    It is true that Charedim, Chabad, Litvaks et al do not agree that the birth of the state implied that one should say Reishit Tzmichat Geulateynu. Some add the word “Shtehe” (rumoured to be R’ Moshe Feinstein’s suggestion) or Smichat Geulatenu.Having finished a book about the Rosh Yeshiva, Rav Amiel ז’ל, of the Gush, a holocaust survivor himself and ardent Zionist, and having a copy of his seminal book המעלות ממעמקים which I read decades ago, it is clear that even some Religious Zionists (like Rav Amiel) have problems with the issue of certainty when it comes to predictions of redemption. It is also for this reason also that I am uncomfortable when people say that XYZ is Mashiach. This type of eschatology, to me, is unimportant. The end is the goal. Exactly who and when and how things happen, as noted by the Rambam in Hilchos Melachim is unpredictable. Having said that, one wasn’t forced to say this prayer. One could easily have just stood like everyone while it was being said. Those who felt that it was just too theologically uncomfortable, could have attended a Tehillim event that was apparently held at Adass Israel on a previous day, although it would be good if they publicised these things in a better manner: they know how.
  4. There were comments about allowing a Conservative Cantor recite Tehillim.
    To be honest, I didn’t know who the (Sefardi) Cantor was. I only noticed the errors in Tehillim that he had made and wondered whether he had bad eye sight. Either way, unless the person is a Kofer/Apikorus, I don’t see an issue with saying Tehillim after him (I haven’t asked my Rav). I would assume the President of ORA checked this out and was satisfied that he wasn’t a Kofer/Apikorus.

My children were near that spot on Thursday night. It is spine chilling. While we normally criticise Neturei Karta for a lack of Ahavas Yisrael, in this case, they have certainly done the wrong thing. They have written about three of their own who (שומו שמים) may have been drafted into the Holy Army defending our Nation.

I find it very hard to support these people. Someone at Shule said “respect their Shita”. Sorry, this poster makes me ill in context. They complain about “ZIONIST MURDERERS”

What Mashiach would want to walk through Meah Shearim? Not even Shabtai Tzvi the faker.

Guest post on the propriety or otherwise of R’ Meir Rabi’s business practices

Several months ago, I brought to the attention of readers of “Galus Australis” that Rabbi Meir Rabi is responsible for the appropriation of the artwork of a famous Hungarian / Israeli / Australian graphic artist: Georg Hamori. Rabbi Rabi has not responded to the specific allegations. Unfortunately, Galus Australis is in the habit of removing all comments from articles that are inconvenient to its contributors. I have included some new comments together with an updated version that incorporates updates I made before Galus Australis obliterated them.

I regard all Australian “Kosher Authorities” as being equally interested in empire building and / or financial gain. Indistinguishable and multilateral examples of this include: “Laffa Matzo” brouhaha; non-direct and non-continuous supervision of “Kosher” eateries; bogus shechita by not observing Kohanic gifts. Even so, I like Rabbi Rabi and some of his positions on Kashrut.

To put my position in perspective for the readers, as far as we know, my family originally lived in Ottoman Palestine and Egypt, India and China. Rabbi Rabi is on the right track about soft matzos. The problem is that the wheat or barley should have been observed from harvest to grinding into flour. Then the dough must be rapidly prepared to prevent fermentation and immediately baked. Worldwide, there are many soft and hard flat types of bread that contain no leaven or aerating compounds and are thoroughly baked before fermentation occurs. I agree with Isaac Balbin that there should only be one Australian Hechsher. The board that operates the hechsher must be representative of all degrees of observance and must be transparent in all its operations.

I’m keenly interested in stamp collecting. Why is this relevant? The other week I was perusing Rabbi Rabi’s It’s Kosher website and found an image of the certificate he uses for providing to manufacturers and retailers. I am reliably informed the certificate is displayed at “It’s Kosher” retailers.

The core image of the certificate is the APPROPRIATED design of the Israeli 150 Pruta stamp commemorating the “Memorial Day for the Fighters for Independence” and “The Seventh Independence Day” by the late; world famous, graphic artist George Hamori. He designed a vast number of stamps, many of which were issued by Australia and Israel. He was born in Hungary, survived the holocaust, immigrated to Israel and later moved to Australia. The Hamori family continue to live in Australia.

The Israel Post Office released this stamp on the 26 April 1955.

Records show that Israel Post had a license to produce a stamp design almost identical to the Israel State Emblem. Looking at the stamp gutter is more information. For comparison, an exact image of the Israel State Emblem is depicted. The stamp design differs to the Israel State Emblem in that the lighting angle is the opposite, the rounded base and stem of the menorah truly depicts the menorah on the Arch of Titus (not stylized as on the Emblem), the font for “Israel” is different and of course there is the addition of flames.

Fact: you or some one working for you must have acquired the image of the stamp and then used software to remove “Israel” in English and Arabic along with the denomination “150″. You should know that the Israel FLAG AND EMBLEM LAW 1949 (5709) ss(3) & (8) and possibly s5 would apply to you and what you have done. There are penalties specified by the Act.

I found this on the Kosher Ve Yosher website of Rabbi Rabi in the legal section:

“COPYRIGHT … We therefore grant permission to publish and disseminate any texts (NOT IMAGES) found in this website …without the prior written consent of Rabbi Meir Rabi.

Publishing information from this site requires:
• that it be used and presented such that it clearly pursues the same objectives as are presented on this website.
• that full credit be attributed to Kosher VeYosher or its Kosher! together with and on the same page as, the relevant texts.
• that the full internet address of the this website and the name of Rabbi Meir Gershon Rabi appear on the same page as the relevant texts. That these attributions be clearly observable on the relevant page.”

Your self-admission that you thought the copyright had expired is telling. This article provides a scholarly discussion of the Halacha in relation to appropriation.

Rabbi Rabi, I feel you are a hypocrite and have demonstrated zero respect for Mr Hamori. Using the State of Israel Emblem for the gain of your Hechsher is reprehensible. Why instead didn’t you create your own original artwork with a menorah? I feel very strongly that you need to discontinue the appropriation of Hamori’s design for the following reasons:

I have to commend Rabbi Rosen. I reproduce his forthright criticism of the hill-top youth below.

So, this is nothing for Rabonim in Melbourne to speak about? I beg to differ. When the Sabra and Shatilla massacres occurred the NRP was against an enquiry until the Rav, rang them up from the USA and berated them for their loss of basic Torah values. They were kafuf to the Rav, and they listened thank God.

Halacha clearly states that a Yid can’t be seen to be less ‘moral’ than the normal world even if you bring 100 proofs that an enquiry is not necessary. There were times when unmarried girls wore hats to shule because the Xtian girls wore them to Church lehavdil. I recall a Tshuva in Yabia Omer on this.

People who resort to a Chilul HaShem when there are clearly other ways, will need to deal with the Aybishter after 120 years; not a pleasant thought.

Someone lurking behind a fake name sent me a comment that I should take down the picture of Moshe Beck in my earlier post because the Rabbi of Adass isn’t responsible for his brothers actions. That is 100% true. I know about this phenomenon unfortunately. It has always been true. But if that lurker with the fake Hungarian name lotzi123 had any guts, he’d name himself AND he’d tell us if it’s true that the Moro D’Asra actually visited his brother and attended Simchos. Is that also untrue and just made up stories ‘Lotzi’

I vehemently disagree with the extremists at Adass. They created their own School. Are they tolerated with sniggles and not open condemnation or Cherem? There are many great and kind and good people at Adass. I speak with them and like them. They ALSO privately bemoan the lurch to Satmar and Skverer extremism. We are brothers, but as Holocaust survivors dwindle the voices of the extremists take over. Is this the Chutzpa Yasge of the Gemora in Sanhedrin portending the Geula? If so bring on the Geula now please. It hurts to see people openly flouting clear Halacha because they think Israel is not from God but from the Sitra Achra. Mimo Nifshach: if it’s Sitra Achra get OUT … why do they stay?

In the least, if you loathe the not yet frum Yidden in Israel (unless you can make a buck off them) keep your thoughts to yourself and stop poisoning the kids with a menu of Sinah and Nekoma and now violence. I heard it with my own ears recently when I listened in to a Melamed teaching children. The Melamed is a Dayan! He was fire and brimstone in his delivery. The next generation has no chance.

How nice it was for once to see Charedim stand silently in the Park on Yom HaZikaron and recite Tehillim while doing so. THAT was a simply executed Kiddush HaShem.

Where are the voices of Rav Kahaneman, Rav Shlomo Zalman and their ilk. They seem to be hiding.

Who are we kidding, the extremists didn’t approve of Rav Elyashiv because he was in Heichal Shlomo paskening Shaylos. Heaven forbid! what a horrible thing he must have done when he freed an Aguna

“Those Ruffians”

Among other things, the destruction of the Second Temple can be “credited” to “those ruffians” – who wore the badge of the Sikarikim (see Gittin 56). They took swords into their hands, convincing themselves that they were taking the law and justice into their hands. And they set up a reign of terror over all that surrounded them, enemies and brothers alike.

What are we talking about? You have probably already guessed from the title of this article: the “Price Tag” ruffians who “fight” the Palestinians and the commanders of the IDF, in the mosques and on the tires of the jeeps – using fire, sharp spikes, and (mainly) graffiti. These thugs have taken on the role of “national irritants” against our enemies, against our lawful governm ent, and (mainly) against the security forces. I do not believe the claim that what we see is a provocation by the Palestinians, by leftist Jews, by the security forces, or by other dark forces. I strongly suspect that we are talking about irresponsible youths who are certain that we will win using an approach of thugs!

I know very well the story of the fanatical attack by Shimon and Levi in Shechem, but in this case I am in complete agreement with the pointed scolding by Yaacov, our father and theirs: “You have made me ugly and spoiled my odor among the inhabitants of the land… I am few in number, and they will gather around me and strike me, and I and my house will be destroyed” [Bereishit 34:30]. Yaacov’s complaint is not only a matter of dissatisfaction (“you have made me ugly”), it literally leads to a curse – “Let their anger be cursed” [49:7], which is accompanied by a punishment of exile, divisiveness and separation from each other – “I wil l divide them among Yaacov and I will disperse them among Yisrael” [ibid]. The best thing for fanatics and for the world is to keep them apart from each other!

“They Stabbed their Rabbi”

I am also well aware that the people bursting with fanaticism will not listen to ethical scolding, do not pay attention to rabbis, and certainly do not weigh their actions in terms of “profit and loss.” They are operating “from a gut feeling” or in response to messianic mysticism, and as far as they are concerned “let the world be consumed!” The proof of how much damage can be caused by such individual acts is provided by a fanatic who has been somewhat forgotten, a man who had a personal very noble record and was not an anonymous “hilltop youth.” I am talking about Dr. Baruch Goldstein from Kiryat Arba, who killed dozens of Arabs in the Machpeila Cave on Purim of 5754 (1994), thereby causing tremendo us damage “and making us ugly.” With what he did, he gave a double-edged sword to our Moslem enemies and to the world. Foolish fanaticism, hallucinatory and murderous, also contributed to the spoiling of the vision of expanded settlements among broad groups of our nation. And this is exactly what is happening before our very eyes as we watch the “Price Tag” events, shaking our heads and shedding tears out of pity: It is a pity that you should waste your youth for no good reason in prison, and it is a pity that you corrupt the righteousness of our path.

And this explains why the cries that are heard from every corner are futile: “Where are the rabbis who can calm them down? Why don’t the rabbis stop them?” We are told that “those ruffians” from the Second Temple era “stabbed their own rabbi!” [Gittin ibid]. They will not be deterred by having us turn our backs on them. In any case, if for no other reason than to reject the claim that we do not scold them, I hereby object loudly and without any limit to their actions. The need to voice an objection is also clear from the quote at the beginning of this article, in the commentary on a verse in this week’s Torah portion – that we are all responsible for each other, especially those who “were able to protest and did not.”

Fanaticism Cannot be Planned

We mentioned Shimon and Levi, the fanatics of Shechem, as providing an inspiration for the “Price Tag” fanatics. It is appropriate to repeat here some relevant points from our sources about the proper attitude towards fanaticism.

“Shimon and Levi were greatly upset by illicit sex, and they each took their swords and killed” [Pirkei D’Rebbe Eliezer 38]. And for this they were scolded by Yaacov. But they “took their swords” spontaneously, without any advance planning, without establishing an organization of fanatics, and w ithout declaring any public policy and designing a “tag” as a symbol of their activity. This is what the sages taught us: “They did not ask Yaacov for advice… and they did not take advice from each other” [Bereishit Rabba 80:9].

The same two brothers meet again in the arena of fanaticism, but in the second case they are on opposite sides. Pinchas the priest (from the tribe of Levi) kills Zimri, a family leader (in the tribe of Shimon) for the sin of immoral behavior with a daughter of Moav. “Pinchas acted against the will of the wise men. Rabbi Yuda said: They would have put a ban on him, if not for the fact that the Holy Spirit came out and said, ‘I hereby give him my covenant of peace, because of his fanaticism'” [Talmud Yerushalmi Sanhedrin 9:11]. The act of Pinchas was accepted because it was spontaneous and not the result of planning. The laws of fanaticism read as follows: “One who has sexual relations with an Aramite woman should be struck by fa natics” [Sandhedrin 81b]. But in the same breath, it is also written there, “One who comes to take advice is not told to do so.”

That is, fanaticism is by definition a spontaneous act, and at times it can be accepted, depending on the circumstances. Fanaticism is always the act of an individual, and establishing any organization or “taking advice from each other” is not fanaticism but the act of a “ruffian.”

Our country, our people, our struggle and extremism

I was not going to post about this topic because I know there are many at Adass Yisrael, the Melbourne Chassidic Charedi organisation, who were upset at what happened and I didn’t want to pour petrol on a raging fire.

Then I received the following video [hat tip MD]. It shocked me to my core. If you understand Ivrit, just a little it will likely do the same to you. Make sure you turn on annotations and captions in youtube for English.

It is plain to see that they have butchered the words of Hatikva to issue calls for the destruction of our homeland and annihilation of our people. We are sixty short years away from a scourge that made no difference between a Rebbe or Mechalel Shabbos. A scourge that didn’t care if someone was from Satmar or from Mizrachi. The common theme is that

עם לבדד ישכון

But who is the עם?

Two incidents occurred with the approval of Rabbinic decree at Adass on Yom Haatzmaut. Now, nobody is saying that people have to give שבח והודאה to Hashem if they feel that the state is a cataclysm for עם ישראל but is this אחיך בלבביך?

Both incidents are outside the rules of Dinim Mefurashim in Shulchan Aruch according to all Rishonim.

  • We don’t say Tachanun at a Bris Mila (שו”ע, סימן קלא, סעיף ד). The Kaf Hachaim says that even other minyanim in that building don’t say Tachanun כה”ח, סימן קעז. The Mishna Brura says that even if the Ba’alei Simcha aren’t there  (משנ”ב, שם, ס”ק כב). Yet, when a recent Bris was held on the 5th of Iyyar (yes, we can assume that they didn’t accept the 6th of Iyyar this year because that was designed to lessen the chance of עבירות) yet at Adass, the Rabbi declared vocally that Tachanun had to be said. The SADNESS and CALAMITY of the establishment of a State overrode in his unpublished and unsourced opinion (I know about the Chazon Ish 60 years ago) the clear requirement not to say Tachanun because there was a Simcha. Perhaps they should have worn sack cloth at the Bris and said Kinos on the floor? When I look at this action in the context of the youtube link above, I feel sick in my stomach. Isn’t it clear to one and all that Tachanun would not have been said because of a Bris? Isn’t it known that the right-wing Satmar branch of Adass are closer to Neturei Karta and the breakaway than they are to the rest of the community and Adass has lurched to the right over the years, especially as the sane voices of holocaust survivors dwindle.  Would this happen at Chabad? No. Would this happen at Beis HaTalmud? I’d venture to say no. Even though Rav Kotler was no uber supporter, he had a fidelity to Halacha. Someone correct me if they say Tachanun at Lakewood on Yom Ha’atzmaut if there is a Bris.
  • There was a poor Adass fellow who was sitting Shiva for his father. During the Shiva,  the Halacha is clear that we do not say Tachanun. Nobody is talking about Hallel with or without a Brocho or anything like that. Tachanun is not said in the mourners house. Yet, because it was Yom Ha’atzmaut, they decided to say Tachanun in contrast to an open halacha שולחן עורך אורח חיים סעיף ד’ ובמשנה ברורה סק”כ. This is a time when the Midas HaDin is threatening and we dare NOT mention sin (Tachanun) in the house of an Avel. But here, the existence of a State of Israel and the possibility that this might be seen to be supporting Yom Ha’atzmaut, was seen (unpublished and unsourced) as more important than the fearful notion of מידת הדין מתוחה, וצריך ליזהר שלא להגביר מידת הדין עליו

So what does one do? My suggestion is that all who are friendly with people from Adass and who agree with my viewpoint express objection in strong terms and ask them why those who were not happy with the unhalachic ruling, decided to say Tachanun. This is not a הוראת שעה from a נביא.

במקום שיש חילול השם אין חולקים כבוד לרב

I fully accept that the Rabbi(s) who must have issued this ruling are careful with the minutest detail of Halacha and are honest and ehrliche Jews, but I simply cannot reconcile this alleged breach of Halacha in the context of that sickening youtube video.

Nobody says one has to agree with ראשית צמיחת גאולתינו … I know many Rabonim who cleverly say סמיכת when it is politically wise to do so, or who add the word שיהא. These are eschatological matters which really don’t concern me too much. I’m happy with plain גאולה as soon as possible.

I consider these actions as tantamount to matching the antics of the ערב רב who visit and visited those despots who seek to dismantle the only Jewish homeland we have, and have had for thousands of years.

Yom Ha’atzmaut: I didn’t find it funny

As I was leaving Shule today, there was a function being held. I don’t know who the caterer was, but it was under Adass supervision. The door was open, and the Mashgiach (supervisor), a rather portly chap was munching on some soup nuts. He was a jovial type and we exchanged a few pleasantries. He then asked me (in Yiddish) do you know what day the Megadef (blasphemer) in today’s Parshas Emor committed his sin? [ The blasphemer who cursed God was the son of Shlomis Bas Divri  and his father was allegedly the Egyptian killed by Moshe Rabbenu (Shmos, second Perek) and he was punished with death for cursing God.]

This Mashgiach of the food (who was a Chossid of some sort, with long Payes, and his Tzitzis Beged on the outside) bellowed that it was the 5th of Iyar (i.e. Yom Ha’atzmaut). I have to admit that I didn’t know if he was telling me the truth in respect of the date and I just wasn’t aware or I was confused with the date of the Mekoshesh Etzim, but it doesn’t matter.

In other words, on the very the day that Hashem allowed the world to grant Israel the ability to be an independent nation, was according to this fellow the same day that the Megadef sinner was put to death for cursing God.

His point was clearly that there was a connection between the two. The notion of a new State for Jews wasn’t a cause célèbre but something akin to cursing God/sinning for which the death penalty was appropriate.

As is my way, I usually find a quick retort, and told him that the correct meaning was that anyone whose distorted weltanschauung saw the establishment of the new State of Israel as a sin/curse, was deserving the death penalty. He snorted, and didn’t respond, and I went on my way.

I simply cannot comprehend how people can speak this way about Israel. I struggle with it. Either they feel that immediately after the Holocaust God decided to “test us” and offer us a State and we should have said “NO”, or they think that the Hester Panim (concealment of God’s visage) during the Holocaust continued further and we shouldn’t have fallen for the “ruse” agreed to by the United Nations, or that we should simply have accepted the view of  R’ Yoel of Satmar, that it is (God forbid) a sin to make mass Aliyah to Israel before the Redemption (as expounded in VeYoel Moshe and discredited as an halachic argument by many Talmidei Chachomim of note).

Having been at the Yom Hashoa commemoration during the week, focussing on the destruction of Hungarian Jewry, and feeling the pain of that episode once more, I find it utterly incomprehensible that soon after 6 million holy people were murdered by the Nazis, that I am meant to see the establishment of a State as  a cataclysmic curse akin to the Megadef (the episode of which has some parallels to the Mekoshesh Etzim in Parshas Shlach).

It is times like this where I am profoundly challenged to consider such people and their views as brotherly. Not only did I not find it funny, I found it grossly offensive (he mistakenly thought I was a Chabadnik, as he had stated).

I am glad that I went home to have a nice Shabbos meal with my mother (a Holocaust survivor who lived, studied and found refuge in the new State of Israel immediately after the war) and managed to control my seething anger.

Phew. I’m physically wasted. Baruch Hashem, our daughter was married last night, and apart from the usual responsibilities of being the “father of the bride” and all that goes with it, I sang and danced during the evening with my great band, Schnapps. That’s not an advertisement. They were simply magnificent last night.

Someone drew my attention to an interesting point which then had me think of the following hypothetical:

If you received an Aliya on Shabbos, and asked the Gabbay to make a Misheberach for Tzahal (Tzva Hagana L’Yisrael) what would the different attitudes be in different Orthodox Shules. I will list those that I believe will have and do have no problem with such a benign (Zionistically speaking) request (and donation)

Perhaps readers can enlighten me on these and any that I inadvertently forgot. I haven’t mentioned Adass yet. I will relay, though, a true occurrence which was at a public gathering of prayer which might shed light on their view.

During the time when those three Charedi Yeshivah Bochurim were arrested and incarcerated in Japan, Adass organised a public gathering to say Tehillim to beseech God to release those boys. At that public gathering, it was suggested (quite vocally) that since Gilad Shalit was incarcerated by Hamas in Gazastan, that he also be included in the Tefillos. I’m advised that the response was like

You can organise your own Tehillim if you want to daven for him

If this is true, it’s an outrageous view. Now, I know this isn’t a universally held opinion. Adass certainly has various categories of views and it’s quite remarkable that those views can co-exist in the one place, however, if Adass President Binyomin Koppel could enlighten  the official view about such a Misheberach, I would be obliged.

Certainly, I have been at Chabad Shules, notably Yeshivah where special Tehillim is said for Israel when it faces many of its challenges.

I raise this because if a Shule does not allow a Misheberach or special Tehillim or similar for Tzahal, then, frankly, I do not want to hear about their special Torah learning protecting the Chayalim. It’s incongruous, is it not?

Similar questions could be asked in respect of Jewish Schools and their allowable activities.

Adass vs Mizrachi

The following correspondence is making the rounds of email on the internet. It sheds light on the basis of the disagreement.

I am receipt of your email statement of behalf of the Mizrachi Organisation.
I am astounded that you would issue such a notice without the courtesy of enquiring about the aim of this gathering
You labelled this “a protest” which was “designed to attract the attention of the general community and the media” organised by opponents of the state of Israel
Unfortunately your statement is totally incorrect.
This was not a “protest” but rather a gathering of Jews – Shomrei Torah uMitzvos from most communities – to say Tehilim and Tefillos against recent decrees aimed at harming the Torah world.
We mirrored the call of the ENTIRE Torah leadership worldwide – Chassidim and Litvaks, Ashkenazim and Sfardim.
The Gedolei Hador are pained at new legislation which further erodes Achdus and Shalom between fellow Jews.
How can anyone sit back and watch as a Jewish State legislates that one Jew will put another Jew into jail for studying Torah?
This is something that saddens all of us and we pray that Hashem should bring us together as one people.

This was not a protest. No one spoke, there was no speeches. No banners or signs – Just tehillim and tefila

It was most specifically NOT done to attract the media. It took place inside a Shul – the most appropriate place for prayer.
There was no contact with the media and no street signs.

You have stated the exact opposite of what we were aiming.   We came for prayer for unity peace and you interpreted it as the opposite.

I think you owe the organisers a public apology for your words.

Dear Binyomin,
I refer to your email of 14 March 2014.
Your letter raises a number of complaints concerning the statement I made on 13 March 2014 which I will attempt to deal with.
First, you say that you are astounded that I would issue such a notice without the courtesy of enquiring about the aim of this gathering.
The aim of the gathering was readily apparent from the poster that was widely distributed. The poster depicted a Sefer Torah wrapped in barbed wire conjuring up the very worst images from our recent history. It called upon men, women and children aged 9 and over to “show solidarity with our embattled brethren in Eretz Yisrael regarding the proposed new law”. It contained images of large outdoor rallies held in Jerusalem and New York.  Although you assert that I should have made enquiries about the aim of the gathering before making any statement, no attempt was made to consult with the Mizrachi Organisation (or to obtain Rabbi Sprung’s signature) prior to organising the event. Presumably that was because it was anticipated by the organisers that Mizrachi would have objected in the strongest terms to what was being planned.
Secondly, you say that I mischaracterised the event by calling it a protest.
When people are called upon to assemble in large numbers to voice their opposition to legislation enacted by a democratically elected government, they are in effect being called upon to protest. A protest need not involve speeches or banners, although I note that similar events held in other cities included such features. You say that the event “took place inside a Shul – the most appropriate place for prayer”. However the poster announced that the rally would take place in the Adass Gutnick Hall.
Thirdly, you state that in organising the gathering you “mirrored the call of the ENTIRE Torah leadership worldwide”.
It is disappointing and troubling that you do not consider Mizrachi and our ideological affiliates around the world, who did not participate in any such events, as part of the Torah leadership community.
Fourthly, you assert that the legislation will mean that “one Jew will put another Jew into jail for studying Torah”.
A cursory reading of the legislation or the available summaries of it will reveal that the law has no such purpose or effect. Its intent is to gradually implement a more equitable sharing of the responsibility for protecting and defending the State of Israel and all of its inhabitants. The law does not come into effect until at least 2017. In the meantime, there is a full exemption for anyone over 26 who did not register in the past and an exemption for anyone aged between 22-26. There will be an option to perform national service rather than serve in the armed forces. Exceptional students will be completely exempt.
Fifthly, you write “We came for prayer for unity (and) peace and you interpreted it as the opposite”.
Scheduling the event on Ta’anit Esther and using the words “Gezeirot Kashot” (ie. harsh decrees) to describe the legislation recently enacted by the State of Israel plainly sought to equate that legislation and those responsible for it with with the terrible edicts decreed against the Jews by Ahasuerus at the instigation of Haman. Actions and statements such as these are plainly calculated to erode achdut. Referring to the Government of the State of Israel as “Shevet HaRasha” (the evil tribe) erodes achdut. How can you claim that you were seeking “unity” and “peace” when you describe fellow Jews in these terms.
I note that, since receiving your letter, two of the seven Rabbis who signed the poster have since expressed deep regret and emphatically dissociated themselves from the document.
You conclude your letter by saying that I owe the organisers of the event a public apology. For the reasons set out above I am not able to apologise for the statement that I made on behalf of the Mizrachi Organisation.

Soldiers in Israel’s Navy who set sail last week on a mission to stop an alleged Iranian weapons shipment from reaching Gaza terrorists celebrated Shabbos together by singing Shalom Aleichem and then making Kiddush and having a seudah.

“As Shabbat began last week, these soldiers had already set sail to stop Iran’s weapons shipment from reaching Gaza terrorists. In the middle of the sea, they all sang ‘Shalom Aleichem’ – a Shabbat song meaning ‘peace be upon you,’” the IDF said. “Days later, their successful mission brought peace upon the entire nation of Israel.”

The members of elite naval commando unit Shayetet 13 gathered below deck to sing together. The soldiers, who mostly wore yarmulkas, put their arms around each other’s shoulders and swayed back and forth as they prayed. After the song was over, one soldier stepped forward and made Kiddush.

Days later, the unit successfully intercepted the arms shipment in the Red Sea. The boat, named KLOSC, was headed to Sudan, 1,500 miles from Israel.

One of the weapons captured, the M-302 missile, is made in Syria and is based on Iranian technology, Israel’s Walla reported. IDF Chief of Staff, Lieutenant General Benny Gantz, oversaw the operation and gave the order to Major General Ram Rothberg, head of the Israeli Navy, to seize the KLOSC, the IDF said earlier this week.

What upset me were the comments section. The various commentators bemoaned the possibility that the video was taken on Shabbos, the last comment though captured how I felt. I didn’t even remotely think for one minute that it was taken on Shabbos. It looked pretty light to me, and it was entirely possible one person hadn’t been mekabel shabbos and took the video because he was so proud of the scene.

While these guys put their lives on the line, the bobbins who aren’t allowed to read the internet can only see darkness and sin. Their eyes are dim, they cannot see let alone imagine light. If they think that for one minute these guys are working on the basis of

then this video is an Open Psak that they are wrong, wronger, and wrongest, but all they feel is that they are wronged. Even הכרת הטוב doesn’t enter their vernacular.

Even though they filmed it, they are still considered tinokim venishba and their effort to recognize Shabbos gave Hashem tremendous nochas. In addition, no matter what anyone thinks about the IDF, they are holy people because they are putting their lives on the line to keep EY safe from our enemies with G-d’s help.

Arik Sharon, may he have a complete Refuah Shelemah

Rabbi Yisroel Rosen of Zomet, wrote the following. I disagree about the Tzeduki part.  I do not believe for one minute that Ariel ever took his eye off the ball or that he didn’t do what he thought was best for his country and people. Rabbi Rosen, with respect, was never in the cauldron of international politics, but lies in Milchamta Shel Torah and Technology. As he lies in a very precarious state, I also believe it is in extremely poor taste for Rabbi Rosen to express these views while the Satan is Mekatreg. If you can’t say something good about someone on their death-bed, don’t say it.

As for the Chashmonaim, we knew they wouldn’t last. They were Cohanim.

From the Depths of the Expulsion…

As soon as Ariel Sharon, the Prime Minister at the time, fell into a sick bed eight years ago, I wrote an article in this bulletin with a title that is still relevant today: “One Tearful Eye and One That is Dry” (Issue 1100, Tevet 5766, January 2006). Here is the beginning of the article, written with tears in my eyes:

“One eye is ‘filled with tears’ for this glorious warrior, often decorated in the past for bravery and strength… He was a man who deserves credit for several of the victories during the past wars. It can be said that in his techniques of war he embodied the military approach of active deterrence, meaning that he moved the battlefield across the enemy lines, to the heart of their fortresses… Sharon educated generations of commanders in the spirit of ‘after me’… As a ‘man of the fields’ from his earliest days, as a ‘man of the land’ who clung to the concept of love of the land, based on his ingrained Mapai instinct, he knew to follow the principle of the Rambam, that settlement provides more of an act of possession than conquest (see Hilchot Beit Habechira 6:16)… in spite of his secular way of life he appreciated the traditions of old, and he insisted on the Jewish identity of the State of Israel.”

The weeping eye, on the other hand, is not for “Arik” the man but for his historical rejection of the principles of Zionism and of the security of Israel, which he had so strongly developed and defended. As far as all those “in the know” are concerned, this turnabout was meant to cover for crimes in the realms of finance and criminal activities. Thus, using transparent and crushing guile he quickly became the “darling of the left” by putting his massive weight behind the operation of evacuating Gush Katif and the Gaza Strip. He knew very well that there are judges in Jerusalem who read the newspaper Haaretz, where an article would be published with a headline along the lines of, “Democracy and Corruption can Wait their Turn.” Those who would destroy you from within were given immunity by the courts of the earth, down below! The deeper the expulsion went, the greater was the level of pardon available.

However, there is also a court in the heavens. And here is what I wrote in this column five months ago (issue 1483, Av 5773, July 2013:

“More than once I have asked myself and my readers what the Holy One, Blessed be He, is hinting at by the unpr ecedented act of suspending Arik Sharon as in a slingshot between heaven and earth, in an unprecedented coma between life and death, for so many years. Can it be that his body and soul will only come to final rest when all of his ‘partners in crime,’ both political and military, will apologize and repent for their actions? So far only a few have done so, and they were mostly lower-level participants. Recently, these people were joined by the deputy head of operations of the police at the time of the events and by one of the perpetrators who came to his senses, General Gershon Hakohen.”

A Commission of Inquiry Before and After

This accusation that has been brought against Arik Sharon, that the decree of expulsion was born as a result of his own personal interest, is based on strong circumstantial evidence, and is a very serious matter. The same is true of accusations of traitorous activity or worse. As time passes, I have been waiting for these matters to be thoroughly investigated by establishing a “Commission of Inquiry of the Motives of the Expulsion from Gush Katif and the Gaza Strip, and of the Results.” This should begin as soon as possible, while those who are privy to the information are still with us.

Another reason for the urgency of appointing such a commission is linked to the frequent repeated visits to our region by the American Foreign Minister, John Kerry. Everybody knows that in the balance Kerry holds the destruction of many settlements in Yehuda and the Shomron (and the Jordan Valley?), G-d forbid. I cannot be sure that a commission will accept the suggestion that the motivations for the previous expulsions were as explained above, perhaps it will leave room for an explanation that the motive was a real hope for and belief in “peace.” But one thing is certai n: In the summary section of the commission’s report, it will be written clearly, in black and/or red, that nothing was accomplished by this move. Just the opposite – on all fronts, we are in a worse situation than before – with respect to security, international relations, deterrence, and of course the values of Zionism and settlement activity.

Did a Chashmonai Warrior become a Tzeduki?

At the beginning of this article, we quoted the words of the sages about the possibility that even Yochanan the High Priest might have become a Tzeduki (who opposed the rule of the Perushim, the traditional rabbis). He might even pour the water of libation (on Succot) on his feet and dirty them, as required by the Tzedukim, instead of sanctifying the Altar of G-d.

In Chassidic lore (in the name of Rabbi Baruch of Mezhibezh, in the book Butzina Din’Hora), a remarkab le assertion is made – that “Yochanan the High Priest” who became a Tzeduki was none other than the father of Matityahu the Maccabee, who is known to us from the “Al Hanissim” prayer (“In the days of Matityahu Ben Yochanan, the High Priest…” – admittedly, many commentators insist that the two priests named Yochanan are not the same person). Thus, we see that even a Maccabee who fought valiantly and with great courage, the few against the many, is liable in the end to reject his status as a warrior.

Rabbi Tzvi Elimelech from Dinov, in the Chassidic book Bnei Issasschar (Kislev-Tevet number 4), also saw the two priests named Yochanan as the same person: “At the time, this great and holy man made a terrible mistake. But then his son Matityahu came and made a new oral mitzva (which the Tzedukim did not accept).”

Will the Matityahu (or is it Netanyahu) of our generation also correct the error of his predecessor?

Satmar think they bring Moshiach by meeting with these people?

I almost choked on my breakfast when I saw that the Teitlebaums, the warring Satmar brothers, both of whom claim to be “Rebbe” of the anti-zionist, Satmar Chassidic Sect had met with, and engaged with Arab billionaires who could hardly be described as lovers of Jews or the State of Israel. To claim it was “Torah Law”, which I understand to be D’ORayso, that one must oppose the state, is simply a Torah furphy, as shown over and over.

I just ask the question: halachically, should one now tell a Satmar collector to go to Sydney Road Coburg (where many Arabs live) to collect funds for their next child’s wedding or should one do otherwise?

I know the Rav always gave them Tzedaka. I do not think they engaged in this, however, in those days. The Rav used to say that the only people you could “trust” in Israel were them and their ilk. They never changed their spots.

Shloshim for Chacham Ovadya זצ’’ל

Major communities around the world, Ashkenazi and Sephardi, have had memorial evenings, or dedicated a special Shiur in memory of this ’Torah Giant’ (I dislike that artscroll term, but in the case of Rav Ovadya, it’s an apt description). It would not be an exaggeration to say that  after Rav Yosef Caro, the Mechaber and Beis Yosef, the author of the Shulchan Aruch, Sephardim have not had a greater Chacham. I’m not sure people realise how incredible Chacham Ovadya’s Halachic expertise was. Stories abound. Yes, there were some unfortunate remarks, but in that regard, I found it very enlightening to read the powerful article from Rav Yisrael Rosen from Machon Zomet, below. A similar scenario occurred with Rav Elyashiv ז’ל. The so called “political apparatchiks” who take advantage of a Gaon, and start to control who comes to see him, his level of interaction with real world, let alone what is going on, have a lot to answer for. These Misaskim, the self-made “important ones” manage to present a fake world to the Chachmei HaTorah by hiding the world from them as they advance in age,  feeding them all manner of untruth.

What about Melbourne? Chacham Ovadya was a Chief Rabbi of the State of Israel. I would like to think that despite the fact that he disagreed with the Lubavitcher Rebbe on the issue of “Land for Peace” and subsequently changed that view after the Gaza fiasco, that our community could get together for an evening of Torah, in memory of his soul. 850,000 or so attended his funeral. If Melbourne, through the RCV, or the JCCV/ZFA, or the COSV or whatever, can’t or won’t organise an evening for his Shloshim, then it is a sign that we are a very disconnected and remote community. I include here even those who are normally at the fringes: Adass, and Beth HaTalmud. They know only too well that Chacham Ovadya was a once in 10 generations genius, with a Hasmada for learning, that was incredible.

R’ Shlomo Zalman Auerbach was once sitting next to Rav Ovadya and remarked that he couldn’t find a Rashi that he was looking for. Rav Ovadya asked him what Rashi said. When Rav Shlomo Zalman told him, Rav Ovadya replied that it wasn’t a Rashi, rather it was a Korban Nesanel on the Rosh in Masechta Rosh Hashona, and opened it up to the spot.

When in his thirties, a set of defaced seforim arrived from Morroco. The librarian of Porat Yosef couldn’t make head or tale of 20 of the seforim. He didn’t know what they were, let alone who wrote them or when. Rav Ovadya looked at them, and after perusing the first few lines of each sefer, he identified 17 of the 20, including the authors and the date and place of publication.

I hope you enjoy the strident view of Rabbi Rosen (re-published below without permission) as much as I did. Much light is shed, and he speaks his mind. [I admit to some pride that Rav Rosen is also an alumnus of Kerem B’Yavneh 🙂 ]

As one who from the very beginning has spent my time on questions of the practical aspects of modern halacha, I grew up on the halachic rulings of the late Rabbi Ovadia Yosef. His image was always before me as one of the ancients – a fearless knight, with a talent to delve into realistic rulings, based on (and in spite of) his intimate knowledge of an amazing abundance of sources which sprawled over the “oceans” of halacha throughout all the generations.

Rabbi Yosef’s works contributed greatly to molding my own path into the field of creative halacha, appropriate for modern times. In preparation for ordination, in the first kollel in the Yeshivat Hesder at Kerem B’Yavne, we visited and were tested by a number of rabbis, crossing over the lines of the different sectors. Among my papers, I have Semicha – an ordination – signed by “the young one, Ovadia Yos ef, S.T., a member of the great Beit Din and previously the head of the Beit Din in Egypt” (5726 – 1966). In his own pearl-like script, he wrote, “He came before me… His name is oil poured forth (see Shir Hashirim 1:3), and he was tested by me… and answered everything correctly… Anybody who wants to can depend on him.”

Zomet Institute was founded (in 5736, 1976) during the time that the rabbi served in Rishon Letzion (4733-5743, 1973-1983). The halachic support that we received from Rabbi Yosef and from his colleague Rabbi Shlomo Goren (together with others, such as Rabbi Shaul Yisraeli, Rabbi Chaim David Halevi, and Rabbi Shlomo Zalman Auerbach) provided us with “support of bread and water” (see Yeshayahu 1:3). Rabbi Yosef’s door was always open to us. As an example, take one of our earliest developments – the “Shabbatphone,” a telephone operating on the principle of “gramma,” for the use of medical staff and for security needs. We presented i t to the rabbi and received detailed approval, which in a way can be viewed as acceptance in principle of the many “gramma” devices which followed. (Rabbi Yosef’s responsa was printed in volume 1 of Techumin, together with the approval by Rabbi Goren. Rabbi Yosef noted that he asked the advice of “Torah giants.” Thirty years later we found that the “Torah giant” whom he consulted was Rabbi Shaul Yisraeli. His reply to Rabbi Yosef was given to us from his papers, and it was published in volume 31 of Techumin.)

While the rabbi held his position in Rishon Letzion, I visited him at home now and then at lunchtime. The rabbi – with the permission of his wife, who was serving soup – was kind enough to answer the questions of the pesky visitor, in a pleasant manner and with great love for “halacha and reality.” His halachic approach, which was widely discussed on the occasion of his passing, was – and remains – a guiding light for us, together with that of other halachic experts who went and continue to go in the same path.

Blockade

All of this was true until the Shas movement was formed as a political entity and entered the Knesset (5744, 1984). In a short time, step by step, the way to the rabbi was blocked for people like me, and possibly for the entire community of rabbis (or perhaps only the Ashkenazim). I checked with friends and colleagues, halachic experts and practicing rabbis, and clearly they too were not allowed to have any contact with the illustrious rabbi and author of the multi-volume responsa, Yavia Omer.

Rabbi Yosef was “locked” for many years in a palace whose doors (and the pathways of incoming information) were controlled by people with vested political and social interests. It seems to me that most if not all of his rulings which were so “revolutionary, dramatic, public-oriented, and considerate” were written in the period before all of this happened. Such matters were blocked at the time, because of the formation of the Shas movement. I admit that if the rabbi had continued exclusively on his halachic path he might well have had a funeral attended by a mere 300,000 people, similar to the number who came to pay their respects to Rabbi Shlomo Zalman Auerbach. The additional half a million people who came were there because of his sectorial and political activities. But the world of Torah and halacha suffered a great loss…

I remember attempting to catch up with the rabbi, after he finished his term at Rishon Letzion, to discuss possible solutions for the Shabbat desecration at the “Shabbat-tarbut” (cultural meetings on Shabbat) in the Habima Theater in Tel Aviv. My efforts were in vain! Similarly, I was unable to reach the rabbi when I was encouraged by the Chief Sephardi Rabbi Bakshi-Doron to establish the Conversion Authority (5755, 1995). On the other hand, I note that as a halachic expert Rabbi Yosef had a fondness for the volumes of Techumin and kept them in a prominent place in his library. He evidently wrote comments in the margins of the books. Every few years his people allowed me a short visit in order to give the rabbi the latest volume and to accept a compliment and his blessings, but never to ask any questions about the issues that interest us at Zomet Institute.

Missed Opportunities

My feeling of a missed opportunity is not only with respect to the matter of halachic rulings. It is even greater with respect to the realm of politics and the various sectors. In spite of the love that Rabbi Yosef had for rabbis and men of halacha, such men were systematically culled from the list of Shas in the Knesset. And of course this was always done in the name of the rabbi and with his approval. We can name a number of such men whom I remember now, some of them alive and others who ha ve passed on: Rabbis Yitzchak Peretz, Shalom Ben Shimon, Yaacov Yosef (the rabbi’s son), Yosef Azran, Aryeh Gamliel, Moshe Maya, and Chaim Amsalem. And there may have been others. The Council of Wise Men of the Torah, which could have included first-rate men of halacha from the Sephardi sector, is made up today of two or three yes-men who are not in this category at all. The council lacks names of prominent men with authority, and I will not name any of them here. Was it Rabbi Yosef who pushed them away, or was it politicians who have a controlling interest in the party? You can make your own guess.

The missed opportunity that is most widespread, in my opinion, is the way that the rabbi’s heart and the Shas movement were pointed in the direction of the Chareidi-Lita’i path. The ultimate proof of the failure of Rabbi Yosef to bring back the old glory and to lift up the banner of Torah of the Sephardim is the fact that most of the children of the Shas MK’s study in the schools connected to Ashkenaz and Lita…

What SIN did he perpetrate?

The story (there have been a few) in Yediot, of yet another Charedi soldier being lynched by those who supposedly sit all day in the Beis Medrash protecting everyone with their Torah, learning as a substitute, is sickening.

What aveyra has he done? Visiting a relative?

In anyone’s language it is at least a Safek Milchemes Mitzvah. If he believes it’s a Milchemes Mitzvah what business is it of anybody else to lynch him? Go your own way. Does he hurt you? He protects you too. Do you really think the Arab spring give a damn about you because you have lange peyos and kiss their feet. Did you every hear about Dhimma? You like it? Go there.

Is this what the Torah meant when it said to give Tochacha if you felt someone was doing wrong?

Where is the permission to hit another Jew for this? You sit in a Beis Medrash all day, so bring me the clear proof that this person is some sort of Apikorus from yesteryear? I don’t want to hear about your Shalosh Shvuos. Sorry to tell you, they aren’t what makes the world go around, and they are not taken seriously by any self-respecting Posek, today.

What about the Chillul Shem Shomayim? Even if you think he is wrong. The best you can do is go to his house and try and convince him that he should be sitting in the Beis Medrash instead, or selling shoelaces in the Shuk. What have you achieved with this violence? Only one thing. You have encouraged your own youth to think that they are all Pinchas, and that this defender of your country is some sort of Zimri. I have news for you all. You are as far way from Pinchas as he is from Zimri. Maybe you are descendants of the Erev Rav.

Where is your Moshe Rabenu? Has he protested against your wanton violence?

What sort of Emuna and Bitachon do you have in your own educational systems if you think that they will crumble because of Nachal Charedi and the like? Was all the learning earlier just a sham? Doesn’t it protect you? Take a look at yourselves.

This section of the Charedi world, with its mostly extreme element, causes people to be turned off Torah and Mitzvos. How many people will not care about Yahadus, because they will say “Zu Torah?”

In the nine days, this is a most depressing incident.

Gevalt. Where are your Gedolim? Where are their Pashkevilim? Why aren’t their Batei Din rounding up these violent people and putting them in Cherem? Why aren’t their faces plastered everywhere?

You try to talk to a Yid, who isn’t yet frum. You face a modern world with all manner of issues and questions. How much longer are we forced to say “ah, they are extremists”. We don’t need extremism. We need the middle derech, the Darchei Noam. If they don’t like it, let them go to Williamsburg.

The word  נועם has disappeared from the vernacular of so many of these Meah Shearim Charedim.

Then they wonder about people like Yair Lapid? They are responsible for it, not his father.

A haredi soldier was attacked by dozens of haredim in Jerusalem‘s ultra-Orthodox Mea Shearim neighborhood. The soldier ran into a nearby building and called in police forces, which managed to rescue him unharmed.

Police said that the soldier, a resident of central Israel, arrived in the Mea Shearim neighborhood to visit relatives. When he was attacked, he fled to a nearby structure, where he changed into civilian attire and contacted police to report the assault.

After clashes subsided, haredim gathered in the area, crying out against haredi soldiers and calling police ‘Nazis.’

Following the incident, Prime Minister Benjamin Netanyahu condemned the attack and said that “we will take a hard line against whoever tries to intimidate the citizens who are fulfilling their duty to the State.”

Netanyahu added that “the best answer for these lawbreakers is the number of haredi recruits, which has increased significantly in the past few years and will continue to grow.”

Defense Minister Moshe Ya’alon also referred to the event and said: “The attack is despicable and abhorrent, and requires serious treatment. We cannot allow violent hooligans to threaten the peace of young haredim who choose to join the IDF .”

Ya’alon further added: “They should be brought to justice with zero tolerance and we will fight this trend with severity. I call on the leaders of the haredi public to condemn the violence and vigorously eradicate such phenomena.”

Nahal Haredi rabbis condemned the attack, saying it was “an act of hatred that is un-Jewish and un-Orthodox”, “blasphemy” and “shame and disgrace”.

An exceptional statement by the rabbis read that “the fact we are at the nine-day period before Tisha B’Av, in which we commemorate the destruction of the Temple, places this act of hatred in a shameful light. It is time for the haredi public to denounce the attackers.”

In response to the riots, Finance Minister Yair Lapid said that “The ongoing incitement against these violent attacks of haredi recruits, such as the grave incident that took place in Jerusalem tonight, are appalling and should be condemned by everyone.”

Lapid added that he intended to hold an emergency meeting with Internal Security Minister Yitzhak Aharonovich in order to see what police can do to prevent such incidents from recurring.

Knesset Committee for Promoting Equal Share of the Burden Chairman Yaakov Peri fiercely condemned the attack and said that “any attempt to physically or spiritually harm soldiers should be dealt with harsh penalties by the State.”

Peri further added that “such event should not be tolerated by the authorities. I ask the leaders of the haredi community to take responsibility before a disaster occurs.”

Shas Chairman Aryeh Deri also condemned the assault, saying “I’m appalled of the deeds of extremist teens who shamelessly hurt a Jewish soldier.”

Violence against haredi soldiers has recently seen a marked rise, possibly due to the public dispute over the draft reform, set to conscript the previously largely exempt haredi sector.

In May, it was revealed that the IDF Advocate General was assembling cases of violence, incitement and assault targeting haredi soldiers, with the purpose of filing indictments against those behind the attacks.

A beautifully arranged presentation, graciously hosted by the Wolfson family, was held this past Motzaei Shabbos regarding the upcoming plan in Eretz Yisrael to conscript yeshiva bachurim into the IDF. Sadly, at the conclusion, I left with a feeling of disappointment.

No questions were permitted from the floor. I had the opportunity to speak with one of the speakers afterwards, who generously listened to me. But that was not the same as a full discussion of a difficult issue.

I am grateful to Rabbi Bender for his infinite chassadim to my family in numerous areas. Any comments I make are in no way intended to minimize the tremendous feelings of respect I have for him. Similarly, I had the opportunity to know the father of Rabbi Ginzberg from my days in yeshiva.

He was a paragon of seiver panim yafos, friendship, kindness, and concern about the welfare of all the bachurim. Any points I raise here are only intended as an exchange of ideas and an expression of deep pain for what I and many others see in the current state of affairs.

I was inspired to devote a number of years to learning in my early youth.

The warm feelings towards Torah, Yiddishkeit, and a Shabbos table filled with ruach will never be dimmed. The desire to maximize that path motivated me to send my kids to chareidi yeshivos where they were given a warm and meaningful Torah education. However, I am deeply disturbed at what has been happening on a wider level in the klal as a whole. I believe I speak for many others, and I know my chaverim have discussed these issues with me, as well.

After introductions by Rabbi Kobre, Rabbi Bender opened with a discussion of the importance of Torah in protecting the klal. He quoted the Gemara in Cheilek that one who says “Mai ahanu lan rabbanan, ldidhu karu ldidhu tanu,” is an apikorus. (One who says, ‘What do the rabbis help us? They only learn for themselves.’ He is considered an apostate.) Rabbi Bender discussed how there were a certain number of yeshiva bachurim learning, while the soldiers fought, during the times of Tanach. He also mentioned how the chareidim have a much lower rate of incarceration in Israeli jails than the general population, thus demonstrating that the Torah teaches good behavior. Finally, he mentioned that there are a number of chareidi organizations which do much chesed for the klal as a whole in Israel, not just for the frum segment, such as supporting the poor and providing assistance with medical issues.

Rabbi Ginzberg focused on why even people who had respect for gedolim in the past, such as those of the stature of Reb Moshe Feinstein, now seem to have wavered, and why questioning daas Torah has become more widespread, particularly on blogs.

Rabbi Eli Paley focused on some of the technical issues, such as how many soldiers the army really needs, and some of his own experiences in the army which seemed to be difficult for a chareidi lifestyle. He seemed to imply that the army is used in some ways as a form of indoctrination and acculturation with the secular viewpoint, rather than as an absolute necessity for security.

Rabbi Kobre mentioned some of the problems chareidi soldiers have recently faced, including medical exams which intruded upon their sense of privacy, and that even in the newer chareidi programs, 25% of the alumni come out non-frum. He took umbrage with a statement from a high level army chief that the chareidim are a worse problem than Ahmadinejad. Rabbi Kobre concluded that this is a state of emergency, and we all need to cry out for salvation.

All of this is true. But it is totally beside the point. The main problem that needed to be addressed, but was totally ignored, is why the chiloni sector has turned on the chareidim at this point in time. It is my belief that we are largely to blame. If it were only a matter of logistics, with the enrollment of more chareidim, suitable infrastructure would be set up so as to better serve them. But that is not at all the point of this article.

For the past 100 years, the chareidi world has been fighting Zionism like it is some kind of poison. They coined fiery slogans such as the Zionists didn’t become frei in order to build a state; they built a state in order to become frei. Aside from being totally foolish, as one can become frei by going to the McDonalds down the block without going through the backbreaking effort of building a state, it is an insult to the downtrodden Jewish people. After suffering 2,000 years of persecution, poverty, plagues, and pogroms at the hands of their host countries, which caused the spirits of many to break, is there no understanding why the status quo was unbearable? Many were converting and leaving Judaism in droves because they couldn’t take the anti-Semitism, discrimination, and misery. Many fled to America or wherever else they could get into.

Theodore Herzl warned that things would only get worse, and his prophecy was 100% correct, as we saw in the Holocaust. He knew the answer was for the Jews to get a place of their own, and he tried his best to help his suffering brethren, despite whatever personal failings he may have had. He did magnificent work. Think about how hard it is to organize a shul dinner, and then imagine how hard it is to organize a country. He had to rally the Jews, raise funds, meet with countless heads of state. The chareidim totally vilified Herzl and forbade any hazkarah in his honor within the city of Brisk after he passed away. The rav of the main shul in town locked the doors to prevent it. But the population was undeterred and broke the lock and held a massive service with thousands of people in attendance. To this day the vilification continues.

In 1923, the Moetzes Gedolei HaTorah passed a resolution condemning the efforts of the Zionists and vowed to fight any attempt to set up a state with all means at their disposal. This was 25 years before the saga of the Yemenite children whose peyos were allegedly cut off. This fighting and denigration of the medinah continues until this day. Chareidim refuse to say the tefillah for the medinah or for the chayalim in their shuls, citing all kinds of Kaballistic reasons, or because we don’t have power to write new tefillos (despite that we say new kinnos on Tishah B’Av for the

Shoah) or other creative points. However, in the old siddur Otzar HaTefilos, written about 100 years ago, there is a tefillah for Czar Nikolai, his wife, his parents, and children, mentioning them all by name, with effusive praise for each. We are allowed to say a tefillah for this individual who was no friend of the Jews, but for our brethren in the Israeli government, it would somehow ruin the davening.

The average Jew is tired of this stuff already. When a Jew goes to Israel and is greeted at the airport by the sign, Bruchim Habaim L’eretz Yisrael, his heart soars. When he enters Yerushalayim and sees the beautiful floral arrangement spelling out Bruchim Habaim LiYerushalayim, and sees the Old City and the Kotel, his heart is torn with emotion. When he sees young soldiers guarding the streets with dangerous weapons, the same age as our kids, who are often roaming the pizza shops, he is amazed at the level of responsibility and maturity they have achieved at such a young age. When he sees how advanced the country has become technologically, such that it exports its know-how all over the world, in areas such as military technology, water management, agriculture, medicine, electronics, software, and nanotechnology, his heart bursts with pride. When he realizes that there is freedom to set up as many shuls and yeshivos as he pleases, without any fear of pogroms or anti-Semitism, he is overjoyed and dumbfounded that for the first time in 2,000 years, this is possible.

Medinas Yisrael is the biggest berachah the Jews have received since the destruction of the Beis Hamikdash.

Now we run into a problem. When somebody tells us that daas Torah is opposed to this, or that the founders of the state were wrong, or bad people, or that we should not say the tefillah for the Medinah, should not celebrate Yom HaAtzamaut, should not sing Hatikvah, should not stand for the memorial sirens on Yom HaZikaron and Yom HaShoah, the average Jew becomes rather confused and torn, with his heart telling him one thing, and all kinds of yeshivishe propaganda that has been drummed into his head telling him another thing.

A little while ago, there was a picture on the front page of the 5TJT of a young child hugging his father’s grave at the military cemetery. The father died so we can enjoy the freedom and the shuls, yeshivos, and mekomos hakedoshim of Eretz Yisrael that we now have. Can chareidim not give this poor child respect for two minutes and stand still while he cries? How dare any leader not emphasize basic decency in his yeshiva.

When a frum IDF soldier is stoned and rained with trash when he enters Meah Shearim, the rest of the country is sickened. We often hear that it is one meshugeneh. Totally wrong. When verbal violence is preached at the top levels, physical violence results at the lower levels.

All the chesed that the chareidim do, while certainly well appreciated (as it is here in the Five Towns, as well), it doesn’t come to a drop in the ocean of the chesed that the Medinah does. The chareidim may provide transportation, food, or advice to people in need of medical treatment.

But who provides the hospitals, medical training, medicines, instruments, research, universities where training and innovation is carried out, and roads to transport the patients and medicines, etc. They also pay for the care, to begin with.

The chareidim give generously to the poor, but how many mouths does the government of Israel feed? Who ensures that the economy runs smoothly, that there is electricity, and engineering training to design a power grid, and water, and chemists who know how to test its safety? Who protects this vast infrastructure, and provides army personnel to stand watch day and night? The Medinah dwarfs all chesed organizations put together. Where is the hakaras hatov?

The klal craves achdus and warmth. The constant anti-Zionist propaganda spewed forth by chareidim is causing giyul nefesh (utter disgust) in me and many of my chaveirim who learned in chareidi yeshivos, not to mention the chilonim themselves.

Rabbi Ginzberg asks why there is a reduction in respect for gedolim. Well, Sunday following parashas Korach there was a massive demonstration where two warring brothers found that they don’t hate each other more than anything else in the world, as previously believed. It turned out that they hate the State of Israel even more. And the entire ideology is based on some obscure aggadeta (Shalosh Shevuos) not brought down in any of the classic codifiers, which is itself based on a verse in Tanach, from which we don’t generally derive halacha, anyway. Incidentally, a possible message of the Shalosh Shevuos is not to rebel against one’s hosts, out of derech eretz. Would that, perhaps, be applicable as well to Jewish hosts, or are they less deserving than King Henry VIII or Queen Isabella? This movement often resorts to outright lies, such as that the Zionists colluded with the Nazis, when letters have recently become available that Ben Gurion begged the British government to allow Jewish fighters to go to Europe to fight the Nazis. They also claim that enormous numbers of Jews have died as a result of the Medinah, when the number is 25,000 in 150 years, far less than in many other similar eras in Jewish history.

Another rav Rabbi Ginzberg is fond of quoting spewed forth the same type of anti-Zionist vitriol for years. One can open up a book of his transcribed speeches in English. This same rav also founded new political parties. One would think some important ideology was at stake. But it was his dislike of a certain rebbe. For some unknown reason, despite this rebbe’s incredible erudition, breadth, and kindness to all segments, this rav considered the rebbe to be inferior to himself. He disliked that rebbe so much that when that rebbe’s wife passed away, he told other rabbanim not to pay a shivah call. The klal is mortified and tired of this. These types of things have led to a weakening of faith in daas Torah.

Is it telling that the preceding two-brother chassidic movement, and the preceding rav’s yeshiva are now both torn asunder by internal machlokes?

Walls have had to be built and smoke bombs have been thrown in the beis medrash of one of the world’s most prestigious yeshivas in Israel. Midah kneged midah? Perhaps. But maybe just the natural progression of things.

When multiple generations have been raised on hatred and sinas chinam, the imbibed hatred is then used on each other, as well.

A few years ago, there was a major chinuch protest demonstration, with all chareidim in Israel urging their followers to attend. What was the issue?

The Israeli government was upset that a certain school was separating the Sephardic girls from the Ashkenazic girls by means of a fence in the middle of the school building, and down the middle of the playground.

Personally, even if a thousand gedolim held a demonstration with a million followers urging people to be cruel to young Sephardic girls, I would follow my heart and simply ignore it, and instead welcome them with open arms. The hamon am is disgusted.

Torah has become an exercise in mental gymnastics, with the primary message being ignored. When Rebbe Akiva said that v’ahavta l’rei’acha kamocha is klal gadol baTorah, he meant it. It supersedes all other considerations. Am I ignoring or denigrating daas Torah? I hope not. Rabbi Ginzberg has mentioned on more than one occasion the importance of keeping mesorah. There is one mesorah we have which is even older than the mesorah of learning—by about 500 years. It is the mesorah of chesed. It was taught by Avraham Avinu. When three individuals who he actually thought were idol worshippers (see Rashi) showed up at his door, he did not spit, as some chareidim now do, at priests of other religions. Rather, he served them a delicious meal and gave them a place to rest, before sending them on their way. Chesed comes before ideology.

When Avraham was told that anshei Sdom were going to be punished, he didn’t smirk that they deserved it, but he screamed to the Ribbono Shel Olam, “Hashofet kol ha’aretz lo ya’aseh mishpat!?” Will the judge of the entire world not do justice!? He was our father, and the father of all peoples of the world. Av hamon goyim.

One of the speakers mentioned that we are experiencing a war against Torah Judaism, an oft-heard refrain of the last hundred years, that the chilonim and Zionists are aiming to destroy Torah and see the chareidim as its symbol. This is needlessly inflammatory (but admittedly effective as a way to rally the troops) and simply false. Reb Aryeh Levine dressed chareidi.

Yet the Knesset dedicated a special day in his honor and made a special plaque which was awarded to him in a major presentation. He worked with all his might to help the fighters in the early days before the state.

After davening, he walked tens of miles on Shabbos to the prisoners in jail to tell the families how their loved ones were doing. He cried out on Rosh Hashanah, mentioning each by name, when they were sentenced to the gallows. The chilonim recognized that he loved them with all of his pure heart. The chilonim, in turn, loved him with all of theirs. If we acted like Reb Aryeh, and gave the chilonim the slightest bit of hakaras hatov and warmth and appreciation for the amazing achievement they accomplished (bsiyata deshmaya), not just as a condescending ruse to be mekarev them, but with a sincere and full understanding of the miracle they created and the intense effort they put in; and if we offered to move our yeshivos to the army bases to keep them company in times of war and be mechazek them with kindness; and if we stopped our foolish and angry (and baseless) rhetoric, they would never think of drafting a single yeshiva bachur. We have only ourselves to blame for this miserable situation. Let us try to rectify it before things get worse.

For now we need to know that there is nothing more to Yiddishkeit than simple kindness and mutual love and respect. In the words of Hillel, idach perusha hi—all else is just commentary. Perhaps it is not the chilonim who have gone off the derech. Perhaps it is us. I am not rejecting daas Torah, rather I am relying on the daas Torah of Reb Aryeh Levine which goes straight back to Avraham Avinu.

Remembering Rav Menachem Froman ז’ל

Recently, I learned of the tragic petirah of HaRav Menachem Froman. He was well-known in the press over many years. Ironically, a founder of Gush Emunim, and described with the pejorative title of “settler”, Rav Froman was the driving force behind the city of Tekoa.

Rav Froman was a thinker, who worked outside the box. He had his own controversial views on how to relate to the Palestinian Arabs (and even known terrorists ימח שמם וזכרם) and many if not most like-minded souls who also moved, with מסירות נפש to far-flung corners of our Holy land, disagreed with his approach.

In his own words:

“My premise is that for Jews to live in all of Eretz Yisrael, they have to create a network of life with the Arabs”, says Rav Froman. “In the Holy Land, you can’t make peace without attending to the issue of holiness”.

“Isn’t it only fitting that Jerusalem be the seat of the United Nations’ cultural bodies, human rights organizations, scholarly forums? Isn’t it only proper that Jerusalem be the place where members of all faiths convene to renounce their breeding of prejudice, hostility, and war?”

Rav Froman truly believed that conciliation and peace lay only through the spreading of Kedusha through faith-based meetings and respect for adherents of Islam. If I’m not mistaken, Tekoa doesn’t have one of those security fences surrounding it. He wanted Tekoa and its residents to feel comfortable with their neighbours. When some Jewish crazies attacked a mosque and set fire, he came to the village and brought replacement texts of the Koran as a gesture of regret and respect.

My cousin, Effrat (née Balbin) (that’s how she spells her first name) and her husband Rabbi David Fialkoff are idealists who live in a caravan in Tekoa. The caravan now houses their bevy of children. They are inspiring and selfless people. David is also a big chassid of Rav Steinsaltz and has impeccable midos tovos. On Shabbos, I used to sing Chabad Nigunim especially for David, who participated with Dveykus.

In 2006, I had the Zchus to attend their wedding. It was then that I first laid eyes on Rav Froman. He was one of those people whose eyes were alive, and who had this aura surrounding him. You could just feel his presence. He had such a peaceful and happy demeanour. I remember he sporadically began a dance before the Chuppa with my Uncle Hershel Balter. He personified Ahavas Yisroel and a love for others. I tried to talk to him and engage him on some of his views, and he simply wasn’t interested. He undoubtedly felt that I was attempting to cajole him into a controversial discussion. He wasn’t having a bar of it. We were at a wedding, and he probably sensed that I wasn’t really at the level of having a meaningful conversation on the topic. After all, I was from Melbourne, Australia. What business of mine was there in talking to someone who was an inspiration to the entire community of Tekoa.

You couldn’t help liking him. If he had worn a Rebbishe Spodik he would have fit the part of a  Jew who had this burning attraction to another Yid’s Neshoma Elokis, and who was attracted to them like a magnet.

I’m told that Tekoa is in severe grief and mourning. It is very difficult for the to cope with the loss of their inspirational leader. In the picture below, which I took back then, Rav Froman is reading the Kesuba while Rav Shteinsaltz looks on.

I liked the man, lots.

The Honeymoon is over

Let’s face it. Charedim have never considered any religious zionists—Mizrachisten) “frum enough”. That’s a generalisation, of course. Notable exceptions, such as Rav Shlomo Zalman Auerbach ז’ל or indeed his son-in-law, Rav Zalman Nechemia Goldberg שליט’’א never saw things in black and white (sic). Rav Shlomo Zalman’s son, Rabbi Shmuel Auerbach, however, is most extreme in his views.

The Charedim were considered “black” (in keeping with their attire) and the religious zionists (with their white crocheted Shabbos Yarmulkes were the white ones). In truth, the right-wing of religious zionists, such as those from Yeshivat Mercaz HaRav, are easily “as frum” as the frummest Charedim, across the board, although they didn’t wear the uniform of hats and jackets or follow the dictates of Agudisten or “Daas Torah”. It’s no different in Melbourne.

We have four kollelim:

  1. The Chabad Kollel
  2. The Lakewood Kollel (Litvishe Misnagdim)
  3. The Adass Kollel (various Hungarian and other Chassidim)
  4. The Mizrachi Kollel MiTziyon (Religious Zionists)

The Chabad Kollel is an arm of the general Chabad movement. People learn there for a couple of years and then go into Chinuch, the Rabbinate, or the general work force. It’s not a life time job to sit in Kollel. The Kollel is interested in people outside of Chabad, in the same way that Chabad is interested in anyone (with the exception of farbrente Misnagdim with whom they share no love).

The Lakewood Kollel was split asunder by a massive disagreement between its own constituents which saw one Rosh Kollel go back to the USA and the other remain in his position. Many important Ba’aley Batim left the Lakewood Kollel, never to return. For many of the full timers, it’s a lifetime job, to “sit in Kollel”. The Lakewood Kollel isn’t really interested in Religious Zionists. It is mainly a common ruse to attract such people to attract funding to support their activities. Behind the scenes, religious zionists are not considered “frum enough”. This is no different to any other such institution around the world.  It is not unique to Melbourne.

The Adass Kollel keeps completely to itself. It is made up of people who have retired as well as young and not so young marrieds. It isn’t interested in the wider melbourne jewish world outside of its own hermetically sealed group and it certainly has no time for Religious Zionist types from a Torah perspective.

Kollel Mitziyon, isn’t really a Kollel. It’s a quasi yeshivah and does a good job continuing the type of learning program that those who studied at religious zionist style yeshivas experienced before returning to Australia. It normally imports a Rosh Kollel and Israeli Hesder Bachurim; their Rabonim though are simply not treated with any respect by the other Kollelim or their constituents.

So what honeymoon is over? Has there ever been a marriage? There has been a “quiet peace” between Charedim and Religious Zionists. While the latter learned in Yeshivos and went to the army, the former generally avoid the army at all costs because they see their torah learning as protecting Jews, and many also see it as a full time, life-long vocation.

Until now.

The new style Mizrachi party, Habayit HaYehudi no longer supports a carte blanche arrangement where significant numbers of Charedim are able to avoid going to the army and sit in Kollel for the rest if their lives. The retribution has been swift. Incredibly, joining the anti-semites and anti-zionists of the world, the Charedi parties have decided to no longer support produce from the “settlements” beyond the green line!

I find this disgraceful. That they could give strength to the types of boycotts imposed by both Jewish and non-Jewish anti-semitic anti-zionists is simply breathtaking, but not surprising. They will stop at nothing to make sure that their sole vocation remains Torah study. To put it in other words, it would be akin to the Lakewood and Kollel Beis Yosef deciding that they would no longer use any businesses associated with the Mizrachi (religious zionists), here in Melbourne. Chabad, of course supports settlement activity given that the last Rebbe was staunchly against returning land for peace.

Idle threats aside: I do not understand why the Charedim do not institute a Hesder system like the Mizrachi did so many years ago. Let them have a ten year Hesder program, where they do 3 years of army interspersed with an extra 7 years of Torah study. What would be so bad? But to boycott any place over the green line in the way they are proposing makes me sick in the gut, and convinces me even more that it was only ever a platonic “marriage”, and the honeymoon is now well and truly over.

The right to pray is sacrosanct

You won’t see the bleeding left, especially those on Galus Australis and the feel-good New Israel Fundniks and the like upholding the inalienable democratic right of a person to pray. No, they will bleat and scream, while complaining that Moshe Feiglin (whose political views I have not studied in detail) is breaking Israeli Law and offending our peaceful Muslim brethren. What is his new sin? According to the Jerusalem Post

According to police spokesman Shmuel Ben-Ruby, Feiglin, who is No. 23 on the joint Likud Beytenu list, prostrated himself in the plaza and tried to pray out loud. Praying aloud, going through ritual motions or using any type of traditional prayer objects such as tefillin, tallitot or prayer books, are forbidden for Jews at Judaism’s holiest site due to tensions with Muslim worshipers at the Aksa Mosque.

Or according to Ha’aretz (try and register and you will see you have an optional “country” called Palestinian Territories (occupied))

Police plan to recommend charging right-wing Likud politician Moshe Feiglin for obstructing them in the line of duty, inappropriate behavior in a public place and violating a legal order. Police detained Feiglin Tuesday for attempting to pray on the Temple Mount. “We expected that the closer the campaign got to Election Day, the more provocations we would see whose purpose is to influence the outcome of the election,” Police Commissioner Yohanan Danino said yesterday. “I have said and I say again: We have no intention of allowing anybody to disturb the peace or break the law.”

Ha’aretz conveniently forgot to mention that Feiglin goes there on the 19th of every month, as omitted by Commissioner Danino, quoted ad loc. As far as I am concerned, if a Muslim can pray there, then so can a Jew. There cannot be one law for the Muslim in Israel. If they can’t control themselves when they see a Jew davening on Har HaBayis, then they should take a bus to Mecca to the Kaaba instead. I am not making a statement regarding the Halachic issue of whether it is permitted or not to stand on Har Habayis. Most hold that it is forbidden, or delineate carefully where one can go. I assume Moshe Feiglin is following his Rabbinic Psak. Let them arrest him. I can’t think of a more stupid act, if they do. Oh, and for the bleeding green left, davening in this way also constitutes the ubiquitous neo-mantra of “Tikun Olam” especially B’Malchus Shadee”.

This is something I wrote for David Werdiger’s excellent “Jews of the CBD” organisation, so it’s reproduced here, for posterity.

 

We pine to know what the future brings. Yet, there is no prophecy in our day. Why? Prophecy provides a temporal glimpse or mirroring of the essence of God and His message. By definition, that transmission must be imperfect, for we are imperfect vessels. What of dreams and their interpretation? In this week’s portion, we see that even Yosef’s interpretation of his famous dream was not accurate because his mother Rachel did not bow down to him. Does this make Yosef a charlatan? Can there be a half truth? We know that the remainder of Yosef’s dream did come true.
Rav Kook explains that the essence was true. The essence is immutable. If Rachel had been alive, then she indeed would have bowed down to Yosef in the same way that Ya’acov did. A dream’s message relates to what potentially could or should have occurred given the confines of human imperfection and condition. Rav Hisda in Brachos 55a says this explicitly. Although we seek advice from the special leaders of our generation, sometimes we find that their predictions are not 100% accurate. But, it needs to be that way because man is an imperfect vessel for the transmission of God’s will. The challenge is to deal with and act on the messages of our time.
For this reason, those who cannot bring themselves to acknowledge that the State of Israel may well be the “beginning” of our redemption because certain minutiae are challenging to reconcile, miss the transcendent and essential message of our time.

Let Eliyahu decide our questions

The Talmud, when faced with a conundrum that cannot be solved, uses the phrase

יהא מונח עד שיבוא אליהו

Let the issue rest until Eliyahu HaNavi comes (back) and advises us of the Halacha

or

תשבי יתרץ קושיות ואבעיות

ֵEliyahu (HaTishbi) will answer all the questions.

The question is asked: since Moshe Rabbenu was our greatest teacher, why do we wait for Eliyahu (who never died) to answer the questions, surely we should wait for Moshe (who will be resurrected when Mashiach comes) and ask Moshe Rabbenu to Pasken/decide the Halachic conundrums.

R’ Teichtal הי’’ד

in his celebrated אם הבנים שמחה, explains that to be a Posek, a Halachic decisor, a Rabbi needs to be immersed in the world. A Rosh Yeshivah, for example, who only interacts with the surreal world of his Yeshivah, is not equipped to be a Posek for the masses. All his answers are designed for the שומר נפש, the Yeshivah or Kollel Jew, for whom being יוצא לכל הדעות, acting according to all stringencies, is the norm. Accordingly, since Moshe has not been interacting in our world for thousands of years, he is not suited to be the Posek when the Mashiach comes. Eliyahu HaNovi, however, who did not die, and lives amongst us, so to speak, is more suitable to answer our questions.

It is also for this reason that the משנה ברורה was not considered as acceptable to normative Psak, as the ערוך השלחן. The Chafetz Chaim was considered like the Rosh Yeshivah who lived in his world, and his method of Psak certainly was biased towards accommodating as many opinions as possible. The ערוך השלחן however was also someone who interacted deeply with his community, and for whom the sight of a woman brandishing a chicken to discover whether there was an issue of Kashrus with that chicken, was not unusual. Similarly, although R’ Chaim Soloveitchik ז’ל also known as R’ Chaim Brisker

was considered the genius of his generation in terms of learning and innovation, R’ Chaim wasn’t a Posek. When people came to R’ Chaim to ask a question, he referred them to R’ Simcha Zelig Reiger ז’ל,

the Dayan of Brisk.  (Incidentally, R’ Hershel Jaeger once told me that some descendants of R’ Simcha Zelig live in Melbourne).

Rav Teichtal, takes this one step further. He considers it immaterial that earlier Gedolim, such as the Satmar Rav or R’ Elchanan Wasserman had a negative view of an en masse Aliya to Israel. Rav Teichtal claims that they, like Moshe Rabenu, were not there to witness the changes in the world, and so their Psak, for today, is irrelevant.

The Eda Charedis is imploding

Hat tip to Dovid, reports coming to hand indicate that there have been a series of arrests at 4:30am in Meah Shearim involving the Shamash of the Av Beis Din, R’ Tuvia Weiss. After a long investigation, it would seem that there has been a massive money laundering operation happening through the offices of the Shamash, Amram Shapira. Also arrested were Shmuel Lubatzki who ran the “charity” known as HaVaad HaArtzi as well as Yossele Sheinberger and Ya’acov Eisenbach. The charges are serious and involve many millions. Through their representative, Yitzchak Shlomo Blau, the Eda have sent a message to the Israeli police that all bets are off, and communication lines are now closed.

I expect that there will be a new ferocious round of violence, tyre and rubbish burning and mass demonstrations. Worse, our friends at Satmar, who are philosophically aligned with the Eda, have suggested that Chassidim demonstrate in the USA against the “religious persecution” of minorities. Will they demonstrate in Australia too?

In the meanwhile, one of the two Satmar Rebbes, R’ Zalman Leib?, has condemned the Belzer Rebbe because the latter dared to suggest that violence may not be the way to deal with the issues being faced. In a rambling tirade, lacking  Torah sources or halachic veracity, the Satmar Rebbe basically said that you can’t fight a lack of kedusha (read Tumah) by adding Kedusha elsewhere. He suggested that one had to “confront” the Tumah. He’s right, but he hasn’t explained why confronting can’t be achieved by increasing Kedusha. He seems to think that Kedusha can’t permeate. We know that is simply wrong! We live in times where the most powerful method to deal with the opposite of kedusha is to bring kedusha to it! You can’t mandate Kedusha through fiat. That’s a medieval approach, at best. It doesn’t work in the free world. Period.

Next time you consider Satmar, remember that although they do great things in Chesed, they are aligned with the Eda Charedis in no uncertain fashion.They are implacably against Israel and their world view is one that is increasingly aggressive against anyone who doesn’t allow their spreading tentacles to transform and supplant an existing landscape with their definitions of Tzniyus etc. It’s in our midst too. Today, in East St. Kilda, as I got out of my car, 3 little boys from the Adass offshoot school said “look the Tziyoni is here” after which they quickly scuttled back up their drive way. Who is teaching these kids such disgraceful hate laden invective? Am I also the Tumah that the Satmar Rebbe and the Eda Charedis wants to “attack”? Are the women wearing Sheytels and Tichels and little girls going to School in Bet Shemesh, the Kochos HaTumah?

We are in big trouble. These extremists have gone way too far. The market needs a correction.

Where is the outrage and condemnation?

Hats off to Rabbi Telsner on Shabbos. In his Drosha at the Chabad Yeshivah Shule in Melbourne, he briefly vent his spleen regarding the Chillul Hashem being perpetrated in parts of Israel by the offshoots, weeds and seeds of the Eda Charedis. Rabbi Telsner’s point was that any “Chassidim” in those groups were not. They didn’t have or display the approach of the Baal Shem Tov on loving each Jew irrespective of the questionable activities those Jews were involved in. R’ Teslner added that the zealots couldn’t be learning Chassidus, and if they claimed that they were, nothing was internalised. Rabbi Telsner was scathing. He said that “all they seem to do is a Chilul Hashem and then they come Schnorring to our doors”. He’s right.

What is the reaction in Adass or Beis HaTalmud? Did Rabbis Beck or Wurzburger have anything to say about these issues? If not, why not? If yes, was it to a cloistered private circle or was it a public comment. If anyone knows, please do inform us. I’m sure many in the community would like to know where these organisations stand on this massive Chillul Hashem malaise.

Responses to Zealotry

Some definitions:

Extremist:  a person who favours or resorts to immoderate, uncompromising, or fanatical methods or behaviour, especially in being politically radical

Fanatic: refers to persons showing more than ordinary support for, adherence to, or interest in a cause, point of view, or activity.

Zealot: stresses vigorous, aggressive support for or opposition to a plan or ideal and suggests a combative stance.

Taking stance that is “not the norm” can be viewed as extremist. In a community of meat-eaters, a vegetarian who is uncompromising may be seen as adhering to an extremist view. Once a community comprises more vegetarians, they cease to be called fanatics. Their behaviour becomes an acceptable norm, albeit of a minority view. In either case, some vegetarians are more vocal than others. We accept the views of someone who is passionate about their vegetarianism. We don’t have a problem with the existence of vegetarian-only restaurants. There are lines, though. Where does society draw those lines?

  • It would be unacceptable to enter a vegetarian restaurant and demand to eat meat.
  • It would be unacceptable to enter a meat restaurant and demand that they cease serving meat.

Why is it unacceptable? Simply because we recognise the right of free choice: an inalienable right; a God-given right. Free choice is the basis of our existence as humans and is the eco-system through which we are able to rise or fall.

Kosher-style restaurants or take-aways are not kosher. It is forbidden by Halacha to eat food prepared in such establishments. Yet, some people on the fringe, do so. You find yourself in an environment where Kosher-style is presented to you. The food is unacceptable and yet your host insists that you partake. They cannot understand what is wrong. There is no pork. It’s supposedly a kosher fish with side salad. What can be wrong with the dressing? You decline. Your host may well be upset, yet you may not be in a position to adequately explain why you cannot take part. Your host may not be in a position to understand or accept your stance. It would be wrong for your host to become angry. Equally, it would be wrong for you to show anger towards your host. There is a gap between your views and theirs. You may also both be somewhat fanatical in your views. You may not understand each other. You may both even be somewhat fanatical in not accepting or understanding the rationale; but there is still a line. This line is the glue which keeps society together. When that line is crossed, we are in danger of falling apart as a unit. The line is crossed when someone is a zealot. You become a zealot when you take an aggressive or combative stance.

Sometimes, in rare cases, a Jew is commanded to sacrifice their life and not compromise their ideals. This is קידוש ה, the sanctification of God’s name that is wrought through death. It is a form of passive aggression. We aspire, though, to live. In regards sanctifying God’s name through living our lives, the Talmud in Yoma quotes a verse and interprets it as follows:

ואהבת את ה’ אלוקיך you shall love Hashem, your God. [This means]

שיהא שם שמים מתאהב על ידך that the name of Heaven [God] should become beloved through your hands [actions]

Ultimately, your actions need to be ones which cause the name of God to remain/become beloved through the mode of your adherence to Torah and Mitzvos. The Talmud then provides some examples:

  • Your business dealings should be honest and upright
  • You should adhere to righteous Jews and learn from their ways and their Torah
  • You should speak with pleasantness

This list is not exhaustive. Clearly, there are many other things that have the potential to both sully or exalt respect for the practice of Judaism. The resultant potential love of Heaven is induced thereby.

The greater test is to stay an honourable, practicing and believing Jew during one’s life. As incredible as Isaac’s preparedness to allow himself to be sacrificed by his father, Abraham, the test for Abraham, who would have had to live with what he did for the rest of his life, was greater. The test to go on living is usually protracted and far more stressful. Similarly,causing God’s name and Judaism to be loved by one’s actions is greater and more challenging through the mode of one’s life and the way one lives.

I am convinced the events of the last few weeks involving a section of the ultra-orthodox, anti-Zionist, community in Israel have caused the name of God and the image of Judaism to be severely tarnished. Halachically,

  • one does not spit at little girls (or anyone for that matter)
  • one does not ask a woman to move to the back of the bus, whether she is dressed according to one’s own acceptable levels of modesty or not.
  • one does not throw stones at people who are not keeping Shabbos
  • one does not yell at people who don’t adhere to a certain standard of dress, even in one’s own backyard
  • one does not compare Jews to Nazis—ever.
  • one does not use the holocaust in an abhorrent pantomime to advance an agenda

To be sure, the anti-Zionist zealots, comprising so-called Sikrikim, Neturei Karta, Toldos Aaron and the others believe that they are “defending” God’s honour. They are, of course, wrong. Their behaviour is nothing short of odious and against Halacha. These zealots  do not act alone. They receive the silent, or “behind closed doors” blessings of their Rabbinic leaders. They will not listen to anyone; we are all Treyf. In their mind, they have a complete mortgage on the truth.

What can we do?

  • We must recognise that there is a sizeable number of “black hats” and “thick stocking” style people, who are also disgusted by this thuggish minority of misguided individuals.
  • We must ask our own Rabbis, yes, each and every one of them, to explicitly make a statement in writing and in sermons to their congregations rejecting the ideology of the zealots as outside the pale of normative Judaism. Statements should be without prevarication. There is no need to speak about anything else. For example, the statement by the RCA is sensibly crafted, whereas the one from the Aguda is disingenuous.
  • There is a group in our own community, constituting a section of Adass Israel Congregation, who fully agree with the philosophy of the zealots. A few days ago, I was accosted in the street, next door to my parents’ house, by a brain-washed boy , who yelled at the top of his lungs “Zionists are Pigs” (in Yiddish). Do not forget that this group of zealots are in our midst. Pockets exist in most Jewish communities around the world.
  • When asking for a statement/response from your Rabbi, it is important to not only include members of the Rabbinic Council of Victoria or the Organisation of Rabbis of Australia. One should also approach the Rabbis of Adass, Beth HaTalmud and other non-affiliated congregations and ask specific questions with no wriggle room. In particular, ask if it is ever appropriate to demand that a woman “move to the back of the bus” even if she is on one of those bus lines where such an pseudo-mechitza is implemented.
  • When a collector comes to your door, ask them the same question. If you don’t like their answers, give them less and someone else more.
  • Avoid apologetics. There is absolutely no justification for this disgraceful anti-halachic behaviour.

Let me end with a story about a true sage, R’ Shlomo Zalman Auerbach ז’ל. In his neighbourhood of Sha’arei Chesed a lady persisted in driving through the otherwise empty streets on Shabbos. Surrounded by the “holy” ones, he was asked, “Surely you have a Torah obligation to protest against this desecration of Shabbos?”. R’ Shlomo Zalman responded that indeed he did have a responsibility to express his dislike for what was occurring. He advised them, however, that throwing stones, or surrounding/blocking the car and/or yelling “Shabbos” achieved nothing. It only served to further aggravate the situation. “So in what way are you protesting?” they asked. R” Shlomo Zalman was quiet. Over the next few weeks, rather than accosting the women who drove through the neighbourhood, they observed R’ Shlomo Zalman as he walked in the street after Shule and came face to face with the car. A look of genuine pain was seen on his face. The lady noticed this look from R’ Shlomo Zalman’s face over the next few weeks, and apparently decided that she didn’t want to cause any angst to this old and pious man. If you are respectful to people, they will also respect you. Don’t cross lines.

We Jews who also try to keep Halacha to the best of our ability must vehemently reject and ostracise this group of unsound zealots and let them know that we are not with them in any shape or form, and that their corrupt version of Judaism is simply an invalid aberration.

Enough is Enough.

Women singing in the Israeli Army

It is well-known that during the British Mandate, there was an important event held in the presence of the two leading religious figures of that time, R’ Avraham Yitzchak HaCohen Kook z”l, and R’ Yosef Chaim Sonnenfeld z”l. The former, of course, became the 1st Chief Rabbi whereas the latter was ideologically opposed to him and Av Beth Din of the Edah Charedis. At this event, in the presence of the British dignitaries, a woman began to sing. To be sure, they undoubtedly had no idea that religious men may not hear live singing of the female variety. The reaction of each of them is interesting:

  1. Rav Kook, a lofty man possessed with an ultra sensitive neshama, stood up in shock and made a quick exit. Nothing else existed at that moment. He instinctively removed himself.
  2. Rav Sonnenfeld put his head down and covered his ears with his hands.

None of us approach the lofty spiritual stature of these holy men. I dare say the same applies to Israeli army conscripts who find themselves at an event where women sing as part of the entertainment/process.

How would/should a Jewish conscript behave if they were part of a non-Jewish army and this occurred? I doubt that they would make a commotion or threaten to “die” rather than stay at the performance. It is likely they would put their head down and/or attempt to block the voice out. Why then in the Israeli army do Jewish soldiers behave differently, as reported in the press? Why do Rabbis of the Charedi Leumi variety demand the most extreme response? The answer is that one expects an Israeli army to be more attuned to the needs of religious Jews. That is a reasonable expectation. However, the reality is that respect is earned. Respect may not be demanded and it is not a byproduct of being genetically related.

We know that דברי תורה בנחת נשמעים, words of Torah are best delivered in a gentle manner. “We demand” is only going to make matters worse, especially in a society which is already alienated by religious jews on account of their not being seen to be pulling their weight in a State sense, and featuring prominently in various cases of moral and ethical malfeasance.

Dogma is part and parcel of our religion; coercion is not. Our purpose is to imitate God—Imitatio dei—והלכת בדרכיו. God, himself, gave us free choice.  What right then do we have to remove that בחירה from a fellow Jew? We are expected to be holy. Holiness means separation. We saw two expressions of that separation above: Rav Kook and Rav Sonnenfeld. What is the appropriate approach then for an ordinary soldier?

It’s obvious to me, sitting here in Australia, from the distance.

  1. Put your head down/close your eyes. Many poskim hold that if you do not see the person singing it’s not ערווה
  2. Bring your fingers up to your ear lobes and block what you can. You can even hum to yourself.
  3. Gently speak to your commander after the event pointing out that it was uncomfortable for you to be in this situation.
  4. Increase Torah and Derech Eretz in your military group.

I’m not sure what else one can or should be expected to do. Walking out en masse and creating a furore simply germinates the same enmity that has transported people to a situation where they already don’t respect each other.

It’s a short step from reacting in a virulent manner to tearing down posters and having Tznius police. Ironically, R’ Kook who did walk out, didn’t do so out of protest. His was but an ultra pure soul that literally fled from a remote smell of  איסור. His Rabbinic leadership was all about gentle enfranchisement and tolerance for those who were not yet observant. None of us are R’ Kook, including the conscripts who perhaps  imitate his reaction.

They have a chip on their shoulders, and much of this is due to unrelenting Charedi delegitimisation of their ideology. Years of Charedi attempts to delegitimise Mizrachi or Torah Im Derech Eretz type Jews are now manifest in less than diplomatic approaches to dealing with the reality of a State before the Geula. Dogma is expressed in virulent and uncaring tones.

We are all worse off as a result. I couldn’t see any קידוש ה’ ברבים

What a pleasure to be here

I have to thank my students. They allowed me to change my lecturing schedule through Sunday lectures so that I could dash off to the Holy Land for my cousins daughter’s wedding. My cousin Jackie z”l after whom our grandson is also named, passed away a year ago and I had promised to attend a wedding should it eventuate: and here I am. It was weird yet comforting to stand in line to board an El Al flight. It’s not Singapore Airlines, but the food is better, even the Hamasbia (I’m frumer than you) meals.

The airline crew work with what I can best describe as “ruthless efficiency”. It’s almost like a military operation. They are quick to serve, and before you can say boo, the tea and coffee is coming. I mucked up my flight plans (typical) and ended up in Hong Kong for the fast, and boarded a few hours before the fast finished. At least on EL Al, without asking, the hostess offered to give me my meal at the end of the fast. I should have asked her to Pasken for me 🙂

There were two other frumaks on the flight, wearing green crocs, and one tried to give me a knowing smile. I don’t know why, but I prefer that people don’t see me as “Charedi”. How could I be. I listen to Jazz (there were billboards today in Meah Shearim saying that it was forbidden to go to frum concerts let alone listen to Jazz); I am a University lecturer; I am comfortable with all manner of people, and don’t see the world in terms of us vs them. Indeed, my refrain since arriving has been to stop people using the word “Chiloni”. It’s a pejorative. I dislike it. The only person who is בוחן לב האדם is Hashem. Sounds cliched but that’s how I view things.

Rav Kook z”l had a famous observation. The Gemara   בבא מציעא נז ע”ב says:

בונים בחול ואחר כך  מקדישים

You don’t use the money from Hekdesh for the building blocks of the Beis Hamikdash, otherwise the builders may come to do aveyros (Meilah). Instead, you use normal building blocks bought from non holy money. Rav Kook said that during the time of building, even the least holy person could stand in the Kodesh Kodoshim! Where are we now? Are we built or are we building? We are building, surely? Even anti or non Zionists would say we are far from built. Based on this insight, which I took to heart many years ago, I look at everyone, including myself, as potential. If we see the potential, we might have a chance to spread kedusha. If we only see the negatives, what’s the point? We create division and hatred. Didn’t Yishmael do Teshuva even though Hashem said to look at him באשר הוא שם?

I feel at home here. It’s surreal and utopian. Yes, I’m only in a Hotel and a typical  tourist. I don’t struggle like the builders who live here; but I feel at home. No place on earth fills me with the feelings that I experience in this Holy Land, in the Holiest city on Earth, Hashem’s chosen place.

Yes, I know, some people, even great people, think that you can make Eretz Yisrael “here”. All that you can hope for is that at the time of Binyan Beis Hamikdash borders will expand and holiness will spread like the proverbial tsunami. In the meanwhile, we live in a second best infrastructure. We may have Kedushas HaTorah and we can seek out Kedushas Yisrael, but we do not have Kedushas Ha’aretz. Combine the three, and you have that winning elusive formula?

Charedim and the State of Israel: then and now

This story originally appeared in שבת בשבתו in 2001 in a weekly Parsha sheet put out by מכון צומת and was retold by Rav Aviner.

During the 1929 riots, on Friday, the 17th of Av, rioters ran wild throughout the country, cruelly ransacking and murdering. In the afternoon, thousands of inflamed Arabs stormed out of the Mosque of Omar after being saturated with the hateful incitement of the Mufti, Haj Amin Al-Huseini, and marched forward, armed with knives and clubs. Most of them advanced towards the neighborhoods of Meah Shearim and Beit Yisrael, with cries of “Slaughter the Jews.” At the head of the inflamed throng marched an Arab sheik, waving a long sword and firing up the rioters not to have pity on men, women or children, since it was a holy war — a jihad.

When the rioters reached the Italian hospital, two Charedi youths emerged from the flour mill at the southern edge of Meah Shearim and advanced towards the rioters. One of them, who had curly side-locks flowing from under his hat, pulled out a pistol and shot straight into the mouth of the sheik walking in front, and he died on the spot. The inflamed masses were seized with fright and they began to flee in the direction of Damascus Gate, while the two youths chased after them, throwing a hand grenade which killed three more rioters. Moreover, the rioters trampled one another to death during their escape.

That same bearded youth who fired the pistol was the saintly Rabbi Aharon Fisher, father of the illustrious Rabbi Yisrael Ya’akov Fisher,

The next day, the great Rabbi Yosef Chaim Sonnenfeld,

who lived in the Old City, had to go to Meah Shearim as a Mohel [circumciser]. His family and friends were terribly worried about him, and they begged him not to go, but he insisted. He would not forego the mitzvah.

The eighty-year-old rabbi, clad in his tallit, walked to Meah Shearim not by way of Jaffa Gate, but by way of Damascus Gate, a troublesome spot even in normal times. He walked calmly along the same route where thousands of murderers had walked, in order to fulfill the mitzvah of circumcision, and he returned by way of Jaffa Gate. When he was later asked why he went precisely by way of Damascus Gate, he responded, “So that the Arabs would not think that they had succeeded in banishing the Jews from even one corner or street in Jerusalem.” And why had he returned by way of Jaffa Gate? “Such is my regular custom, in order to fulfill the words, “Walk around Zion. Circle her” (Psalm 48:13) (BeDor Tahapuchot, Rabbi Shlomo Zalmen Sonnenfeld, pages 226-229;393-396).

It is well-known that the illustrious Rabbi Yosef Chaim Sonnenfeld was not a Zionist. Quite the contrary, he ascribed to the opposite view. He was the most Charedi of Charedim, and an opponent of Rabbi Abraham Isaac Kook.

To say that the Charedim did not sacrifice themselves for this land is a severe libel.

Meah Shearim was established on a spot where people were afraid of bandits.

The Charedim sacrificed themselves for the Land, or more precisely, for the word of G-d, who commanded us to settle the Land.

Have the courage of your convictions

People do not agree. This is a fact of life. There are, and always will be, emotive issues which evoke strong disagreement. Sometimes the disagreement can result in feelings of aggression even hate between antagonists. Jews are no different. If anything, because there are many issues of substance lingering around our Daled Amos, there is perhaps more opportunity, perhaps even propensity, to viscerally agree to disagree.

Rav Dov Lior, Chief Rabbi of Kiryat Arba and Hevron

Two recent examples of differing approaches to courage and expressing the truth of one’s convictions confronted me this week. The first involved Rav Dov Lior, Chief Rabbi of Kiryat Arba and Hevron, and Rosh Yeshiva and head of the Rabbinic Council for Judea and Samaria. Rav Lior is considered to be a star pupil of Rav Tzvi Yehuda HaCohen Kook, z”l, and one of the  brightest among Gush Emunim style adherents of the concept of a greater Israel. Born into a Belzer family and subsequently orphaned, Rav Lior was touted as an Illuy even amongst the Charedi population of the State of Israel. Rav Lior and others gave their Haskama to a book which was considered to be “inciting” by the police and other authorities. Refusing to back down, Rav Lior is now likely to be arrested. Rav Lior claims that the arrest warrant interferes with his right to offer religious approbation to a book related to Torah thoughts and principles.

You can agree or disagree with Rav Lior, but you will never die wondering what his views are on a particular topic. He says it like it is, and his views are like he says. There is no diplomatic licence employed to bury his thoughts or camouflage his principles for fear of a physical or financial backlash. Rav Lior, his supporters and students, do not cower underneath rocks like proverbial green moss, afraid of the consequential glare of sunlight. Rav Lior subscribes to a philosophy that sees the hand of God in the creation of the State of Israel.

Diametrically opposed to his views are those who endorse the position of the late Rebbe of Satmer, Rav Yoel Teitelbaum z”l. Rav Teitelbaum held that the primary (perhaps only) reason for the Holocaust was God’s “retribution” against the actions of zionists who dared transgress the 3 oaths. These views, largely held by the Hungarian charedi population, are considered utterly abhorrent by many. It is simply beyond comprehension to fathom the concept of 6 million Jews murdered, gassed and burned and amongst them תנוקות של בית רבן who were hurled against walls to have their skulls fractured, all because God was angry that they dared defy British anti-semites and seek to re-inhabit ארץ אבותינו.
